PR Newswire: Multiple Lawsuits Against TAM Airlines

Masry and Vititoe Partners, MIAMI, March 26 /PRNewswire/ PRESS RELEASE — Internationally recognized aviation attorneys Steven C. Marks and Ricardo M. Martinez-Cid with the Podhurst Orseck law firm have filed a series of lawsuits on behalf of families of passengers killed in Brazil’s worst airline disaster. On July 17, 2007, 199 people perished when TAM Airlines Flight 3054 slid off the runway at Congonhas Airport and slammed into an air cargo building in Sao Paulo. Today, Podhurst attorneys filed 59 wrongful death complaints related to the catastrophe in the U.S. District Court for the Southern District of Florida.

In addition to TAM NYSE: TAM, which is charged with its own negligence and that of its pilots and maintenance personnel, the defendants in the lawsuits are Pegasus Aviation IV, Inc.; Airbus S.A.S.; Airbus Industrie G.I.E. (EADS) (EAD.PA); Airbus Customer Services, Inc.; Goodrich Corporation NYSE: GR; and International Aero Engines AG.

“Responsibility not only lies with the companies that manufactured and handled maintenance for the aircraft,” said Marks, “We believe Airbus provided inadequate customer support, simulator services, and training materials for the pilots and flight crew that replicates the performance of the aircraft in all normal and abnormal conditions.”

Marks said it’s clear the flight crew knew there were problems with the aircraft before the disaster because the plane’s right thrust reverser had been deactivated before the flight.

“The thrust reverser is used to slow the jet down upon landing. Without an operational right thrust reverser, it didn’t have enough room to stop on the runway, ending in a horrific crash when the plane skidded off the runway’s edge,” he said.

Podhurst Orseck filed the first lawsuit related to the crash on behalf of the family of 35-year-old Ricardo Tazoe of Miami, an employee with Banco Santander. In all of the cases, the plaintiffs are seeking a jury trial to recover financial damages for pain and suffering; lost value of life; funeral expenses; and all other damages they may be entitled to under the law.

Marks and Martinez-Cid have extensive experience handling Brazilian aviation matters. They currently represent the families of numerous passengers who were killed when Gol Transportes Aeros Flight #1907 collided with an Embraer Legacy 600 business jet over the Amazon Rainforest in September 2006.

    Philippine Airlines Plane Returns to Manila due to Smoke in Cabin

    Philippine AirlinesPhilippine Airlines flight PR-422 had to return for an emergency landing in Manila, Philippines, on September 26th.

    The Airbus A340-300 plane took off for Tokyo, Japan, but had to return shortly afterwards after the crew reported smoke in the cabin.

    One Two Go Disaster

    Perth expatriate Robert Borland, 48, survived Sunday’s crash of discount airline One-Two-Go when it slid off the runway and burst into flames on the island resort of Phuket. Borland’s family wants to find the man who rescued him from the burning plane. 89 passengers and crew were killed, and 41 injured. 57 of the injured were foreigners. Forensic police have now identified 21 of the foreign victims Civil aviation officials have said the pilot had received permission to abort the landing at the last minute.

    There were no survivors of the Tam Airbus crush on July 18. All 186 people aboard the ill-fated Brazilian TAM flight 3054 died in a fiery crash in Sao Paulo. Thirteen people on the ground also were killed. The Airbus 320 careened off the notoriously short runway upon landing at Sao Paulo’s Cagonhas airport, skidded across a crowded avenue and slammed into a warehouse where it burst into flames.

    Though nearly 1.5 million dollars in indemnities to families of victims, only one case has settled. Other of the Tam Air cases are in negotiation. Counselling treatment and funeral costs are also expected to be covered.

    Thirty-four Missing in Nambia

    A Linhas Aéreas de Moçambique Embraer ERJ 190-100 IGW (ERJ-190AR) disappeared in bad weather with poor visibility while en route from Luanda Airport Angola to Maputo International in Mozambique when it lost contact with ATC at 11:26 on Friday 29 November 2013.

    The plane disappeared. A fruitless search Friday was cancelled due to rain and resumed Saturday. The wreckage was found in Nambia on Saturday. It had crashed in Bwabwata National Park-a protected game area and migration route 2,422 square miles. None of the twenty-seven passengers or six crew survived.

    The wreckage was found burned out, the bodies scattered, near the Angola-Botswana border in a wilderness area. The black boxes were recovered by investigators.

    It is with great pain and consternation that LAM confirms the tragic event of crash of the Embraer 190 aircraft with registration C9-EMC that made the flight TM470 Maputo-Luanda, last November 29, 2013.

    At the end of the morning, the Namibian aviation authorities confirmed that the search and rescue team had located the place where the plane crashed in the North of Namibia, there are no survivors.

    Right now, our prayers and our full attention go to the relatives of the passengers and crew who were aboard this plane, dedicating all our moral and psychological support in order to minimize the pain for the loss of their loved ones. This is our priority.

    As the first form of assistance the LAM established a family support centre at the airports of Maputo and Luanda. Were assigned to these centers, specialized professionals for this type of events with the aim of providing the due advice to families. At the same time our legal department is working to give all judicial assistance with regard to the procedures to be followed after a plane crash where there have been fatalities.

    The flight TM470 took on board 27 passengers and 6 crew members.

    The nationalities of the passengers were the following:

    Mozambique (10);
    Angola (9);

    The crew comprised two pilots and three cabin crew and a technician.

    LAM has already informed the embassies of countries whose citizens perished in this accident.

    Engage an international company specializing in the management of disasters of this nature, Kenyon International, to support the efforts of the search and recovery of the remains of the victims and their belongings. For families this aspect is quite important because it will enable the identification of each person who was aboard this flight.

    Part of Kenyon’s team is already on the way from the crash site being that the other party will join them tomorrow, arrived from England. We hope to have a clearer assessment about the scene of the accident throughout the day tomorrow, Sunday.

    LAM sent this afternoon for Namibia an emergency response team to provide all the support to the authorities who are investigating this accident. According to international aviation rules, Namibia, a country where the accident occurred, should lead the investigation. Aeronautical authorities of Mozambique, Angola, Brazil and the air transport safety Bureau of the United States will also participate in the investigation.

    Do we still have information about the circumstances in which the accident occurred, and we can’t even speculate on the likely causes of the same, since we should give time and space for researchers to conduct their work without interference.

Follow aboard 28 passengers and 6 crew members.

    Information obtained gives indication of the aircraft have landed in Rundo, northern Namibia, bordering Botswana and Angola.

    Currently LAM, Aeronautics and airport authorities are committed to establish contacts in order to confirm the information.

    Turkish Airlines Flight Diverts to Vienna due to Fumes in Cabin

    Turkish Airlines flight TK-1945 made an emergency landing in Vienna, Austria, on October 9th.

    The Airbus A320-200 plane heading from Istanbul, Turkey, to Brussels, Belgium, was diverted after the crew reported fumes in the cabin.

    The plane landed uneventfully. All one hundred and twenty-nine people aboard remained unharmed.

    French Researchers Lost Lives in Antarctica

    What: Institut Polaire Français Aérospatiale AS 350 Squirrel helicopter carrying supplies between the French research vessel and supply ship, l’Astrolabe and the country’s Dumont d’Urville research base in Adélie Land.

    When: October 28, 2010
    Who: 4 Fatalities
    Why: After taking off from the French research vessel L’Astrolabe which is icebound northeast of the Dumont-d’Urville station, the helicopter went down in bad weather. The helicopter was last seen flying at 29 feet. The helicopter normally supplied the research base. Initially there was hope of one survivor. A U.S. Air Force C-17 flew over; the distress beacon was activated off Adelie Land, but cloud cover prevented visibility; bad weather complicated rescue efforts. An Australian unit which spotted three bodies dropped supplies and survival equipment. A doctor flown in later confirmed that the pilot, the mechanic and two employees of the French Polar Institute who had been aboard the helicopter were dead. The remains were recovered and flown back in an Australian Hercules C-130 to a chapel at the base. (US) McMurdo base and AMSA’s rescue coordination centre are assisting the French recovery team.

    Two researchers were from l’Institut polaire Paul-Emile Victor, in Brest, Brittany, France.

    Finnair Emergency Landing in Germany

    What: Finnair Airbus A320-200 en route from Paris to Helsinki
    Where: Hamburg
    When: Jan 1 2011
    Who: 100 passengers
    Why: While en route, it was discovered that a windshield was cracked. The crack did not appear until after takeoff. The flight diverted to Hamburg Germany where they made a safe landing. It was a routine landing. Finnair sent another Airbus A320 to transport passengers.
