    NTSB SAFETY RECOMMENDATION

    The National Transportation Safety Board recommends that the Federal Aviation Administration:

    Require that the hover performance charts published by helicopter manufacturers reflect the true performance of the helicopter in all conditions for which the charts are applicable, including light and variable wind conditions. (A-10-148)

    Develop and implement a surveillance program specifically for 14 Code of Federal Regulations (CFR) Part 135 operators with aircraft that can operate both as public aircraft and as civil aircraft to maintain continual oversight ensuring compliance with 14 CFR Part 135 requirements. (A-10-149)

    Take appropriate actions to clarify Federal Aviation Administration (FAA) authority over public aircraft, as well as identify and document where such oversight responsibilities reside in the absence of FAA authority. (A-10-150)

    Require the installation of fuel tanks that meet the requirements of 14 Code of Federal Regulations 29.952 on S-61 helicopters that are used for passenger transport. (A-10-151) Require that S-61 helicopters that are used for passenger transport be equipped with passenger seats and seat mounting structures that provide substantial improvement over the requirements of Civil Air Regulations 7.260, such as complying with portions of 14 Code of Federal Regulations 29.561 and 29.562.     Require operators of transport-category helicopters to equip all passenger seats with restraints that have an appropriate release mechanism that can be released with minimal difficulty under emergency conditions. (A-10-153)

    Require that Advisory Circular 21-34 be used to evaluate all shoulder harness retrofit installations and to determine that the installations reduce the risk of occupant injury. (A-10-154)

    Require operators of Sikorsky S-61 helicopters with General Electric model CT58-140 engines to install 10-micron airframe fuel filters. (A-10-155)

    Require Carson Helicopters, Inc., to put a conspicuous notification on the title page of the Instructions for Continuing Airworthiness that accompany its supplemental type certificate for installing side-mounted seats indicating that the installation does not provide enhanced occupant protection over that provided by the originally installed seats and meets Civil Air Regulations 7.260 standards.     Require all applicants for supplemental type certificate (STC) seat installations in any type of aircraft to put a conspicuous notification on the title page of the Instructions for Continuing Airworthiness that accompany the STC indicating whether the installation provides enhanced occupant protection over that provided by the originally installed seats and the certification standard level met by the seating system.     Require supplemental type certificate (STC) applicants to improve the crashworthiness design of the seating system, such as complying with portions of 14 Code of Federal Regulations 29.561 and 29.562, when granting STC approval for older transport-category rotorcraft certificated to Civil Air Regulations 7.260 standards.     Also, the National Transportation Safety Board reiterates the following previously issued recommendation to the Federal Aviation Administration:

    Do not permit exemptions or exceptions to the flight recorder regulations that allow transport-category rotorcraft to operate without flight recorders, and withdraw the current exemptions and exceptions that allow transport-category rotorcraft to operate without flight recorders. (A-06-18)

    FAA and Port Authority of New York and New Jersey Reach Agreement on Airport Safety Violations

    WASHINGTON – The Federal Aviation Administration (FAA) and the Port Authority of New York and New Jersey (PANYNJ) have reached a settlement agreement about aircraft rescue and firefighting (ARFF) violations from December 2010 to June 2012 at four New York area airports owned and operated by the PANYNJ — John F. Kennedy, Teterboro, LaGuardia, and Newark Liberty International.

    “We expect all airports to comply with our safety regulations and to correct any deficiencies immediately,” said U.S. Transportation Secretary Ray LaHood. “These violations were egregious, and they will not be tolerated.”

    Under the agreement, the PANYNJ agrees to pay a $3.5 million fine within 30 days. If there is a violation of the settlement agreement, the FAA will impose an additional fine of $1.5 million and will assess an additional $27,500 daily for each violation. In addition to the fine, the PANYNJ has agreed to take the following actions, with FAA approval, to address the underlying problems that led to systemic noncompliance with ARFF requirements at the four airports:

    • The Port Authority will create a dedicated ARFF force to carry out airport-related ARFF functions with no collateral police officer duties.
    • The staff will report directly to the Department of Aviation and be operational no later than March 31, 2014.
    • The Port Authority will hire an ARFF fire chief and facility captains as soon as possible, but no later than March 31, 2014.
    • The Port Authority will submit a curriculum for training to the FAA on or before December 31, 2013, which includes at least 75 hours of initial ARFF training and 40 hours of annual recurrent firefighting training in addition to Part 139 training, pertaining to an airport’s operational and safety standards and providing for such things as firefighting and rescue.
    • The ARFF personnel will work a 12-hour shift.
    • The Port Authority will amend the airport certification manuals for the four airports to include: an organizational chart; a process to maintain ARFF training records; and a description of ARFF operations, including shift assignments, personnel training records management, and Department of Aviation oversight.
    • The Port Authority will conduct monthly internal audits of ARFF training and shift assignments and annual external audits to ensure that all ARFF personnel assigned to a shift are trained.

    “We expect the Port Authority to have trained safety personnel to ensure the safety of the travelling public and airport personnel, just like we have at all airports in the United States,” said FAA Administrator Michael P. Huerta.

    The FAA became aware of ARFF violations as a result of an annual airport certification safety inspection of JFK in December 2011. The FAA also discovered similar violations at Teterboro, which prompted a full review of training at LaGuardia, Newark Liberty International, and Stewart International Airports. The review of ARFF training revealed violations at LaGuardia and Newark, with no violations at Stewart.

    The FAA believes the settlement agreement provides the best long-term solution to ensure ARFF compliance, given the systemic nature of the PANYNJ airport problems.

    Boeing, Alaska Airlines Complete Contract for 15 Next-Generation 737s

    SEATTLE, Jan. 25, 2011 /PRNewswire/ — Boeing (NYSE: BA) and Alaska Airlines today announced an order for 15 Next-Generation 737 airplanes, comprised of 13 737-900ERs (extended range) and two 737-800s. The 737-900ER is a new model for the Alaska Airlines fleet. The contract, which includes exercised options previously placed by Alaska, is valued at $1.3 billion at list prices.

    The largest and newest model in the 737 family, the 737-900ER can carry up to 26 more passengers or fly about 500 nautical miles (926 km) farther than the 737-900. The longer range of the 737-900ER will connect distant city pairs across continents, such as Seattle to Orlando, Fla., in a generous two-class configuration. It has substantial economic advantages over competing models, including six percent lower operating costs per trip and four percent lower operating costs per seat mile. Alaska Airlines plans to operate the 737-900ER in a two-class configuration with 178 to 184 seats.

    “The reliability and efficiency of our 737 fleet has been a direct contributor to our strong financial performance,” said Brad Tilden, president of Alaska Airlines. “The 737-900ER will be a perfect fit for our transcontinental, high traffic west coast and mid-continental markets and will be the most fuel efficient airplane in our fleet.     The Next-Generation 737s will add capability to Alaska Airlines’ fleet of 114 737s currently serving 61 destinations in the United States, Canada and Mexico.

    NTSB ASSISTS GOVERNMENT OF LEBANON IN AVIATION ACCIDENT

    The National Transportation Safety Board will dispatch an aviation investigator to assist the government of Lebanon in its investigation of the crash of an Ethiopian Airlines B- 737-800 (ET-ANB) off the coast of Lebanon.

    At approximately 2:30 a.m. local time on January 25, the aircraft crashed into the Mediterranean Sea shortly after takeoff.

    NTSB Chairman Deborah A.P. Hersman has designated senior investigator Dennis Jones as the U.S. Accredited Representative. His team will include technical advisors from the Federal Aviation Administration and Boeing.

    The investigation is being conducted by the Directorate General of Civil Aviation of the Government of Lebanon, which will release all information on the progress of the investigation.     Fourth Investigative Update on Boeing 787 Battery Fire


    NTSB Provides Fourth Investigative Update on Boeing 787 Battery Fire in Boston

    WASHINGTON – The National Transportation Safety Board today released a fourth update on its investigation into the Jan. 7 fire aboard a Japan Airlines Boeing 787 at Logan International Airport in Boston. The fire occurred after the airplane had landed and no passengers or crew were onboard.

    The event airplane, JA829J was delivered to JAL on December 20, 2012. At the time of the battery fire, the aircraft had logged 169 flight hours with 22 cycles. The auxiliary power unit battery was manufactured by GS Yuasa in September 2012.

    NTSB investigators have continued disassembling the internal components of the APU battery in its Materials Laboratory in Washington, and disassembly of the last of eight cells has begun. Examinations of the cell elements with a scanning-electron microscope and energy-dispersive spectroscopy are ongoing.

    A cursory comparative exam has been conducted on the undamaged main battery. No obvious anomalies were found. More detailed examination will be conducted as the main battery undergoes a thorough tear down and test sequence series of non-destructive examinations.

    In addition to the activities at the NTSB lab, members of the investigative team continue working in Seattle and Japan and have completed work in Arizona. Their activities are detailed below.

    ARIZONA
    The airworthiness group completed testing of the APU start power unit at Securaplane in Tucson and the APU controller at UTC Aerospace Systems in Phoenix. Both units operated normally with no significant findings.

    SEATTLE
    Two additional NTSB investigators were sent to Seattle to take part in FAA’s comprehensive review. One of the investigators will focus on testing efforts associated with Boeing’s root cause corrective action efforts, which FAA is helping to lead. The other will take part in the FAA’s ongoing review of the battery and battery system special conditions compliance documentation.

    JAPAN
    The NTSB-led team completed component examination of the JAL APU battery monitoring unit at Kanto Aircraft Instrument Company, Ltd., in Fujisawa, Kanagawa, Japan. The team cleaned and examined both battery monitoring unit circuit boards, which were housed in the APU battery case. The circuit boards were damaged, which limited the information that could be obtained from tests, however the team found no significant discoveries.

    Revised Safety Rating for India

    India’s Directorate General of Civil Aviation (DGCA) has been notified that the US is downgrading its aviation safety ranking, based on failure to meet the standards of the ICAO. The International Civil Aviation Organization regulates technical, training, inspection, records, airworthiness, and operations standards. The safety downgrade is partially due to a September FAA audit which found 33 DGCA deficiencies including too few experts, maintenance deficits and poor documentation.

    India’s being lowered to safety category II means that there will be consequences affecting Air India and Jet Airways Indian flights.

    Press release: FAA Announces Revised Safety Rating for India
    The U.S. Department of Transportation’s Federal Aviation Administration (FAA) today announced that India has been assigned a Category 2 rating under its International Aviation Safety Assessment (IASA) program, based on a recent reassessment of the country’s civil aviation authority. This signifies that India’s civil aviation safety oversight regime does not currently comply with the international safety standards set by the International Civil Aviation Organization (ICAO); however, the United States will continue to work with India’s Directorate General for Civil Aviation (DGCA) to identify the remaining steps necessary to regain Category 1 status for India. With a Category 2 rating, India’s carriers can continue existing service to the United States, but will not be allowed to establish new service to the United States.

    India achieved a Category 1 rating, signifying compliance with ICAO standards, in August 1997. A December 2012 ICAO audit identified deficiencies in the ICAO-set global standards for oversight of aviation safety by India’s Directorate General of Civil Aviation (DGCA). Subsequently, the FAA began a reassessment of India’s compliance with ICAO standards under the FAA’s IASA program, which monitors adherence to international safety standards and practices. The FAA has consulted extensively with the DCGA and other relevant Indian government ministries during its evaluation, including consultations in India in September and early December, and meetings this week in Delhi.

    “U.S. and Indian aviation officials have developed an important working relationship as our countries work to meet the challenges of ensuring international aviation safety. The FAA is available to work with the Directorate General of Civil Aviation to help India regain its Category 1 rating,” said FAA Administrator Michael Huerta.

    The Government of India has made significant progress towards addressing issues identified during the September 2013 IASA assessment. On January 20, the Government of India took further steps to resolve outstanding issues when the Indian Cabinet approved the hiring of 75 additional full-time inspectors. The United States Government commends the Indian government for taking these important actions, and looks forward to continued progress by Indian authorities to comply with internationally mandated aviation safety oversight standards.

    Additional Background on the FAA’s IASA Program:

    As part of the FAA’s IASA program, the agency assesses on a uniform basis the civil aviation authorities of all countries with air carriers that operate or have applied to operate to the United States and makes that information available to the public. The assessments determine whether or not foreign civil aviation authorities are meeting ICAO safety standards, not FAA regulations.

    A Category 2 rating means a country either lacks laws or regulations necessary to oversee air carriers in accordance with minimum international standards, or that its civil aviation authority – equivalent to the FAA for aviation safety matters – is deficient in one or more areas, such as technical expertise, trained personnel, record-keeping or inspection procedures.

    Countries with air carriers that fly to the United States must adhere to the safety standards of ICAO, the United Nations’ technical agency for aviation that establishes international standards and recommended practices for aircraft operations and maintenance.
