    Madrid Crash Case Should Be Tried Here, Not Stuck in Spanish Amber

    March coverage included the news of Central District of California U.S. District Judge Gary Allen Feess dismissing the case against McDonnell Douglas (and component manufacturers) because he believed the litigation of the airline crash case should be moved to Spain. Spanair Flight JK 5022, the deadliest Spanish accident in the last 20 years, killed 154 people (18 survivors) when it crashed just after takeoff at the Barajas Airport in Madrid.

    Here is the problem:
    In Spain, Spainair filed for a delay which was granted, and now, criminal proceedings have pre-empted civil proceedings, which now makes the Madrid case stuck in Spanish suspended animation.

    Families believe that this new development should allow their case to be reconsidered in US Courts.

    Suspending civil proceedings until criminal proceedings are concluded could extend the length of time it takes the aviation case to complete. Aviation cases normally take a long time to settle anyway)

    According to forum non conveniens, the court court can dismiss a case where another court or forum is better suited to hear the case. (Plaintiffs refer to another Spanair crash case which took eleven years to settle.)

    The judge’s decision was based on his opinion that that private and public interest factors weigh in favor of shifting the litigation to Spain. But now that the case will be delayed indefinitely pending the judiciary of Spain’s criminal case, the interest of the families who were affected by the crash has in effect been swept aside.

    How is that in anyone’s best interest? Why must the victims’ justice wait on Spain looking at two maintenance personnel have been charged with negligent homicide?

    The judge cited “drawbacks associated with translating the cockpit voice recording” but, as Boeing was a technical adviser to the U.S. investigative team, and downloads, transcripts and the cockpit voice recorder are part of evidence already secured in the United States which cannot be secured in Spain.

    Plaintiffs argue that family members were injured or died because of problems with the wing slats and flaps (component failure). The facts support the case being tried in US Courts.

    Bell #HelicopterCrash in China

    A helicopter crash occurred in Miyun county in Mujiayu township, China, a suburb of Beijing.

    The report was received from 11:40 at Beijing emergency center which sent a medical evacuation helicopter to the wreckage to transport the survivors.

    Jinhaihu Landscape Man Park Aviation Club was owner/operator of the Bell 407 helicopter in which flight training was underway when it crashed.

    Both injured pilots were hospitalized, one with hand injuries and the other with brain trauma. One of them died in the hospital.

    No cause for the crash has been indicated. The accident is under investigation.

    Small Plane Crashes into Virginia Home; 3 Injured

    A small plane crashed into a home in Topping, Virginia, on October 7th.

    Authorities said the plane struck two trees and crashed into a home, shortly after departing Hummel Field.

    There were three people aboard, including two adults and a juvenile. All of them sustained minor injuries and were taken to Rappahannock General Hospital.

    No one was home at the time of the crash.

    The incident is under investigation.

    Plane Crashes Kansasville Garage

    What: Beech A36 Bonanza en route from Chicago Executive Airport to Minocqua
    Where: Eagle lake Kansasville, Racine County, WI
    When: Sept 9, 2012
    Who: 1 fatality
    Why: The pilot who had been en route from Chicago Executive Airport to Minocqua crashed into a Kansasville Wisconsin garage but avoided hitting any of the neighborhood houses in Eagle Lake. the plane, a garage, and two cars were destroyed; and two homes sustained damage. Debris and plane parts were scattered over the immediate area.

    Witnesses say that when the plane hit, it shook the neighborhood.

    The FAA and Racine County Sheriff’s Office are investigating.

    Small Plane Crashes in Alaska; Pilot and His Dog Killed

    A small homemade plane clipped some trees and crashed in a street on the Anchorage Hillside, Alaska, on September 10th.

    There was only the pilot and his dog aboard.

    Both of them lost their lives in the crash.

    The cause of the crash remains under investigation.

    Lantana Tragedy


    What: Beechcraft 35 Bonanza owned by James BREAZEAL of Florida
    Where: LANTANA, FL
    When: 05/06/2009
    Who: Two fatalities, pilot and passenger: Jack Henderson of Lake Worth and James Breazeal of Windermere were killed in the crash.
    Why: AIRCRAFT, ON LANDING MISSED THE RUNWAY AND CRASHED INTO A PARKED AIRCRAFT, THE TWO PERSONS ON BOARD WERE FATALLY INJURED, LANTANA, FL, Air worthiness Date: 08/18/1959

    Although the airport is saying a new engine was recently installed, investigators believe that engine failure caused the plane to crash. The plane clipped parked planes and collided with a trailer, with the engine dislodging on impact. Apparently the rest of the plane “crumbled” on impact with the hanger.
