    NTSB SAYS NORTHWEST PILOTS’ DISTRACTION LED TO OVERFLIGHT OF MINNEAPOLIS, NOTES ATC SHORTCOMINGS; ISSUES RECOMMENDATIONS ON ATC PROCEDURES

    Washington, DC – The National Transportation Safety Board has determined that Northwest Airlines flight 188 overflew its destination airport of Minneapolis by more than 100 miles and failed to maintain radio communications because the pilots became distracted by a conversation unrelated to the operation of the aircraft. The NTSB’s accident brief, released today, also note air traffic control shortcomings during the event, and the Board issued two safety recommendations to address those shortcomings.

    On October 21, 2009, Northwest Airlines flight 188, an Airbus A320 (N374NW) operating as a scheduled flight between San Diego and Minneapolis, did not communicate with air traffic control for approximately one hour 17 minutes. While in this NORDO (no radio communications) state, it flew past its intended destination at a cruise altitude of 37,000 feet. The crew subsequently re-established radio communications and landed without further incident. There were no injuries.

    The NTSB said that the pilots continued to fly through several air traffic control sectors without replying to any radio commands. The investigation found that the pilots had become engaged in a conversation dealing with the process by which pilots request flight schedules and during the conversation each was using his personal laptop computer, contrary to company policy. The pilots were not aware of the repeated attempts by air traffic controllers’ and the airline to contact them until a flight attendant used the intercom to inquire about the progress of the flight.

    The NTSB also found that the lack of national requirements for recording ATC instructions when using automated flight tracking systems, such as directing an aircraft to switch frequencies or to indicate that an aircraft has checked in on an assigned frequency, was a factor in the controllers delay in performing necessary actions and notifications required by lost communications procedures. In addition, because NORDO events of a short duration are not uncommon, the Safety Board found that controllers and managers may have become complacent in completing necessary NORDO actions and required notifications in a timely manner.

    As a result of deficiencies in ATC communications procedures revealed in this investigation and an accident involving a Pilatus PC-12/45 that crashed in Butte, Montana on March 22, 2009, the Safety Board is making recommendations to the FAA to address the following issues:

    The lack of standard procedures for identifying flight crew-ATC communications in ATC facilities that use automated flight tracking systems.
    The lack of standard phraseology for identifying the emergency nature of emergency ATC radio transmissions.

    Previously, the Safety Board has addressed the potential hazards created by the use of personal electronic devices by transportation operators. Last month, following the Board’s investigation of the Colgan Air 3407 accident near Buffalo, NY, the Board issued a safety recommendation to the FAA to require all Part 121, 135, and 91K operators to incorporate explicit guidance to pilots, including checklist reminders as appropriate, prohibiting the use of personal portable electronic devices on the flight deck.     Recent accidents and incidents such as the midair collision over the Hudson River last August, Colgan Air flight 3407, and the Northwest pilot’s overflight of the Minnesota airport have demonstrated the clear hazards to aviation safety when pilots and air traffic controllers depart from standard operating procedures and established best practices.

    The Safety Board will convene a 3-day public forum on professionalism in aviation to address methods for ensuring excellence in pilot and air traffic controller performance. The forum is intended to raise awareness by promoting an open discussion between the Safety Board and invited panelists drawn from industry, labor, academia, and government on the importance of developing and reinforcing professionalism in the aviation industry. The forum is scheduled for May 18-20, 2010. More information regarding the forum will be announced in the coming weeks.

    GE and AVIC Sign Agreement for Integrated Avionics Joint Venture

    GE Aviation of the United States and Aviation Industry Corporation of China (AVIC) today announced the signing of the agreement to form their new joint venture company. Chinese Commerce Minister Chen Deming and the U.S. Commerce Secretary Gary Locke witnessed the public signing by David Joyce, president and CEO of GE Aviation and Zhang Xinguo, vice president of AVIC today in Chicago.

    The new AVIC and GE joint venture company will develop and market integrated, open architecture avionics systems to the global commercial aerospace industry for new aircraft platforms. This system will be the central information system and backbone of the airplane’s networks and electronics and will host the airplane’s avionics, maintenance and utility functions. GE and AVIC will continue to service their legacy programs and existing contracts with customers. The agreement is subject to government approvals and the issuance of an operating license.

    This 50/50 joint venture represents a significant milestone in the growing aerospace relationship between Chinese aviation industry and GE Aviation since the mid-1980s. Chinese airlines now operate more than 2,500 jet engines produced by GE and CFM International (joint company of GE and Snecma), with an additional 1,000 engines on back order. GE Aviation’s collaboration in China also involves investment in a network of facilities for technical training, manufacturing, spare parts distribution, and engine maintenance and overhaul. Additionally, GE is powering China’s new ARJ21 regional aircraft and CFMI was selected to power the new Chinese C919 aircraft.

    The new GE-AVIC joint venture extends the relationship beyond engines into commercial avionics. It will enable GE and AVIC to grow a business together that will create jobs globally, including hundreds of new jobs in the US, the UK and China.

    “GE is extremely pleased and excited to be a part of this unique aviation business. The JV will build on the extensive avionics capabilities of both companies and create a technology center of excellence to serve the commercial aviation market,” said David Joyce. “GE’s aviation business in China results in 1,800 high-technology jobs in the U.S. The jobs are involved in producing and supporting jet engines for China, as well as developing the new engine and avionics system for the C919.”

    The joint venture company will be headquartered in China and will be the single route-to-market for integrated avionics systems for both GE and AVIC for new commercial aircraft. Also, GE and AVIC will each provide avionics products to the joint venture company as a customer and distributor.

    “The combination of AVIC and GE’s aviation experience, technical know-how and people skills will lead to the development of highly competitive commercial avionics products,” said Zhang Xinguo. “AVIC is looking forward to a long and successful partnership.”

    The name of the joint venture is GE-AVIC Civil Avionics Systems Company Limited. The joint venture will have its Chairman and General Manager nominated by AVIC and GE respectively with final approval from its board of directors. The company will be initially located at Zizhu Digital Hub Science Park in Shanghai until a permanent location is secured.

    “The joint venture will work to secure systems and other avionics products on future aircraft adding to the overall economic value and jobs created,” said Lorraine Bolsinger, president and CEO of GE Aviation Systems. “The JV and C919 program will support and maintain at least 300 high-tech jobs locally in each the US and China. This venture will challenge our team to come up with break-through technology. GE and AVIC will together develop a world-class engineering organization and the JV itself will be creating new IP and new technology. This is a 50/50 partnership; you have to be all in and be very committed.”

    The initial focus for the joint venture is integrated avionics systems for the C919 aircraft. This selection was formalized in a Letter of Intent with COMAC memorialized in a public signing on July 12, 2010. COMAC anticipates delivering more than 2300 C919 aircraft over the 20-year life of the program. This market potential provides an estimated value for the AVIC GE avionics systems of approximately $2 billion.

    Jeff Immelt, Chairman and CEO of GE and Lin Zuoming, president of AVIC, originally signed the framework agreement on November 15, 2009 regarding the formation of the visionary joint venture and the intention of jointly creating a market-leading integrated avionics system supplier.

    Since a major restructuring in November 2008, the AVIC Group has been ranked in the Fortune’s Global 500 list with a diversified aviation business portfolio ranging from helicopter-making to plane manufacturing. The company has also developed strong capabilities to supply avionics products to various models of aircrafts, both for military and civil use.     Continental Announces New Tentative Agreement With Flight Attendants

    CHICAGO, Jan. 4, 2011

    Continental Airlines today announced that it has reached a tentative agreement on a new labor contract with the International Association of Machinists and Aerospace Workers (IAM) representing Continental flight attendants. The IAM is expected to hold a ratification vote in the coming weeks.

    “The negotiation teams were able to reach a fair agreement that is another positive step forward as we work to combine our companies,” said Sam Risoli, vice president of Inflight Service for the combined company.

    The agreement covers approximately 9,300 Continental flight attendants located throughout the United States.

  • Five Reportable Incidents Added To Notification Requirements

    The NTSB is amending its regulations concerning notification
    and reporting requirements regarding aircraft accidents or
    incidents. In particular, the NTSB is adding regulations to require
    operators to report certain incidents to the NTSB. The NTSB is also
    amending existing regulations to provide clarity and ensure that
    the appropriate means for notifying the NTSB of a reportable
    incident is listed correctly in the regulation.

    On October 7, 2008, the NTSB published an NPRM titled
    “Notification and Reporting of Aircraft Accidents or Incidents and
    Overdue Aircraft, and preservation of Aircraft Wreckage, Mail,
    Cargo, and Records” in the Federal Register. This NPRM proposed,
    and the final rule codifies the addition of five reportable
    incidents, the reporting of which the NTSB believes will improve
    aviation safety.

    The operator of any civil aircraft, or any public aircraft not
    operated by the Armed Forces or an intelligence agency of the
    United States, or any foreign aircraft shall immediately, and by
    the most expeditious means available, notify the nearest National
    Transportation Safety Board (NTSB) office when an aircraft accident
    or any of the following listed serious incidents occur:

    • Failure of any internal turbine engine component that results
      in the escape of debris other than out the exhaust path.
    • In-flight fire.
    • Aircraft collision in flight.
    • Release of all or a portion of a propeller blade from an
      aircraft, excluding release caused solely by ground contact.
    • A complete loss of information, excluding flickering, from more
      than 50 percent of an aircraft’s cockpit displays known as
      Electronic Flight Instrument System (EFIS) displays, Engine
      Indication and Crew Alerting system (EICAS) displays, Electronic
      Centralized Aircraft Monitor (ECAM) displays, or other displays of
      this type, which generally include a primary flight display (PFD),
      primary navigation display (PND), and other integrated
      displays.
    • Airborne Collision and Avoidance System (ACAS) resolution
      advisories issued either when an aircraft is being operated on an
      instrument flight rules flight plan and compliance with the
      advisory is necessary to avert a substantial risk of collision
      between two or more aircraft, or to an aircraft operating in class
      A airspace.
    • Damage to helicopter tail or main rotor blades, including
      ground damage, that requires major repair or replacement of the
      blade(s).
    • Any event in which an aircraft operated by an air carrier lands
      or departs on a taxiway, incorrect runway, or other area not
      designed as a runway, or experiences a runway incursion that
      requires the operator or the crew of another aircraft or vehicle to
      take immediate corrective
    • action to avoid a collision.

    The final rule was published in the Federal Register January
    7th, and the revisions and additions published in this final rule
    become effective March 8, 2010.

    $155,000 in Civil Penalties Against American Eagle Airlines

    FORT WORTH, Texas – The Federal Aviation Administration (FAA) is proposing $155,000 in civil penalties against American Eagle Airlines of Fort Worth, Texas for allegedly operating eight flights with incorrect weight and balance data, and for using improper maintenance procedures when repairing a jet engine and then operating the aircraft when it was not in compliance with FAA regulations.

    FAA inspectors observed 12 American Eagle flights arriving at Dallas/Fort Worth International Airport, Dec. 28-29, 2010. In eight instances, loading documents for checked luggage did not match observations made by the inspector.

    American Eagle’s FAA-approved weight and balance program calls for the use of an automated Electronic Weight and Balance System (EWBS) to make sure aircraft are operated with correct weight and balance information. However, accurate data must be entered for the EWBS to function properly.

    Operators may not exceed an aircraft’s weight limit when loading the plane and the weight must be distributed so that the aircraft remains in balance during the flight. The FAA alleges American Eagle entered inaccurate data in the EWBS, then operated the aircraft with incorrect weight and balance information. The proposed civil penalty is $80,000.

    The FAA also alleges American Eagle used improper procedures to repair an engine on one of its Embraer 135 regional jets, and that a mechanic signed off as “complete” on work he had not performed. As a result, American Eagle operated the aircraft on 34 flights between Sept.11 and Sept. 17, 2010, when it was not in compliance with regulations. The proposed civil penalty is $75,000.

    American Eagle has 30 days from the receipt of the FAA’s enforcement letters to respond to the agency.
