    Press Release – FAA Issues First-Ever Spaceport Grants to Strengthen Commercial Space Activities

    WASHINGTON – The Federal Aviation Administration (FAA) announced a new grant program designed to fund projects that develop and expand commercial space transportation infrastructure. The Space Transportation Infrastructure Matching Grants will be awarded to four separate projects located in Alaska, California, Florida, and New Mexico.

    “The Obama administration is committed to making sure the United States remains the world leader in space development and exploration,” said FAA Administrator Randy Babbitt. “This new grant program underscores that commitment, and will help ensure that the commercial space industry can meet our current and future space transportation needs.”

    In June of this year the Obama administration unveiled a new National Space Policy that recognizes opportunities and advancements in commercial space capabilities. The 2010 policy lays out more specific ways for the government to make use of commercial capabilities.

    The FAA’s Office of Commercial Space Transportation will administer the new Space Transportation Infrastructure Matching Grants. The first matching grants include: $43,000 for the New Mexico Spaceport Authority to provide an Automated Weather Observing System; $227,195 to the Alaska Aerospace Corporation for a Rocket Motor Storage Facility; $125,000 to the East Kern Airport District in Mojave, Calif., for an emergency response vehicle; and, $104,805 to the Jacksonville Airport Authority in Florida to develop a Spaceport Master Plan for Cecil Field. Under the law, the FAA can provide matching funds for specific projects being carried out by public entities involved in commercial space activities.

    The United States’ space program has three sectors – civil, military and commercial. The FAA’s Office of Commercial Space Transportation is responsible for licensing, regulating and promoting the commercial-sector space industry. Since the office was created in 1984, the FAA has issued licenses for more than 200 launches, licensed the operation of eight FAA-approved launch sites known as spaceports, and has helped ensure that no loss of life or serious injury has been associated with these efforts.

    Training! Training! Training!

    The NTSB was discussing safety measures in late October, especially pilot training before stalls. The new rule has been a long time coming. Earl Weener, a member of the National Transportation Safety Board, talked about the serious history of pilots wrongly pulling the plane’s nose up till the plane fell to the ground. If training is part of the problem, then at least that is a lack that can be amended.

    Only twenty-six percent of pilots train for high altitude stalls, but according to a NASA study, twenty-eight percent of stalls are high altitude stalls. Seventy-one percent of stalls happen while autopilot is on.

    In early November we heard how the FAA unveiled a rule about pilot training to avoid stalling airliners. It came about because of four crashes: Those crashes were Colgan 3407 in 2009, Air France 447 in June 2009, Pinnacle Airlines 3701 in October 2004 and USAir 427 in September 1994. (Too bad there have to be stall issues before stall training came to the attention of officials.) In the February 2009 crash of Colgan Air, it was determined that the pilots–as in the three other flights–in the midst of a blizzard in Buffalo pulled up on the nose of the plane, causing the crash. A meeting of air safety leaders in late November has jump-started the plans. Though something that has taken so long in the works can hardly said to be jump—started.

    The powers that be sound positive about the new rule.

    The FAA speculates training will save nearly seven million because of prevention—at a program cost of $274 million. Within five years this will mean:

    • Better ground and flight recovery training
    • Better pilot flight monitoring each other
    • Better runway safety protocols
    • Better crosswind training.

    I have been beating a drum for a long time about obvious solutions to obvious problems. Yes, things may fail, but why not implement preventative measures where available? So now rather than my usual battle-cry: Maintenance! Maintenance! Maintenance! Maybe I will be saying Training! Training! Training! I am looking forward to increased safety brought about by this new rule.

    Pilot Fatigue Fact Sheet

    Last year, U.S. Transportation Secretary Ray LaHood and Federal Aviation Administration (FAA) Administrator Randy Babbitt identified the issue of pilot fatigue as a top priority during the Airline Safety Call to Action following the crash of Colgan Air Flight 3407 in February 2009. Administrator Babbitt launched an aggressive effort to take advantage of the latest research on fatigue to create a new pilot flight, duty and rest proposal based on fatigue science.
    Updated rules are necessary and must take into account today’s modern, global aviation system. After years of debate, the FAA published a landmark Notice of Proposed Rulemaking (NPRM) in September 2010 which would allow pilots more rest and give airlines the flexibility to integrate fatigue science into their scheduling practices.
    This new proposal recognizes that airplanes operate globally over multiple time zones and that short-leg, multi-leg, and long-haul flights all present challenges. In addition, technology has evolved to enable airplanes to fly much further than in the past. In this environment, a variety of factors can affect pilot alertness, judgment and performance. Those factors include: the time of day of a flight; day-night or night-day transitions; daytime sleep periods; time off between consecutive work periods; the number of takeoffs and landings in a given time period; the impact of time zone changes on circadian rhythms; early start times; and commuting.
    The proposal includes provisions related to a pilot’s commute, including consideration of commute time when determining rest periods, and consideration of flight and duty time in relation to a pilot’s “home base.” The FAA welcomes public comment on strategies to address this important issue.
    While FAA rules already state that a pilot must be fit for duty, the FAA is proposing to strengthen that requirement. Under the proposal, an air carrier would not be able to assign (and, a pilot would not be able to accept) an assignment if the pilot is too fatigued. In addition, a company employee who suspects a pilot of being too fatigued to perform his or her duties during flight would be able to report that information to the air carrier, so that the air carrier could make a determination of whether or not the pilot is too fatigued to fly.
    The public will have 60 days to comment on all provisions in the proposal which is available at http://www.faa.gov/regulations_policies/rulemaking/recently_published/.
    The FAA will then issue a final rule by August 1, 2011.
    What is fatigue?
    Fatigue is a general lack of alertness and degradation in mental and physical performance. There are three types of fatigue: transient, cumulative, and circadian.
    In aviation, fatigue may cause a pilot to fall asleep during cruise flight or it may impact alertness during take-off or landing. The National Transportation Safety Board (NTSB) has included an item to “Reduce Accidents and Incidents Caused by Human Fatigue in the Aviation Industry” as an action area in their aviation safety “Most Wanted List.”
    Although sleep science is evolving, research has indicated that most people need eight hours of sleep in 24 hours to perform effectively, and the average person needs in excess of nine hours of sleep per night to recover from accumulated sleep debt. Most people find it more difficult to sleep during the day than at night. In addition, the risks of fatigue and making a mistake increase the longer a person has been awake and working on a task.
    Key differences between the new proposal and the current rules
    The proposal reflects the universal nature of fatigue. The proposed rules would be the same for all types of Part 121 flights (passenger and cargo airlines): domestic, flag (international), or supplemental (unscheduled). There are currently different requirements for each of these categories of operations. The proposed rule does not apply to Part 135 operators, but FAA may address fatigue for Part 135 operators in the future.
    Unlike the current rules, the proposal provides a circadian component for reducing the flight time and duty time when the pilot is operating in his or her window of circadian low.
    The proposal clearly states that fatigue mitigation is the joint responsibility of both the airline and the pilot. A pilot may not accept an assignment if that pilot is too fatigued to fly.
    The proposal would give airlines the flexibility to adopt individual Fatigue Risk Management Systems. Fatigue Risk Management Plans, recently mandated by Congress and now addressed by FAA policy, would set out a carrier’s own policies and procedures for reducing the risk of fatigue and improving alertness. These plans are specific to an air carrier’s type of operations, are subject to the FAA’s review and acceptance, and include fatigue education and awareness training.
    Rest
    The FAA proposes to set a nine-hour minimum for rest prior to flying-related duty, a one-hour increase over the minimum in current rules.
    Flight Time
    Weekly: Currently, pilots flying domesticallyare limited to 30 hours of flight time in any seven consecutive days. Those flying international operations are limited to 32 hours in seven consecutive days, and there is no seven-consecutive-day limit for supplemental operations. The proposal provides pilots with at least 30 consecutive hours per week free from all duty, compared to the current 24 hours free from all duty on a weekly basis – a 25 percent increase.
    Monthly: Under the proposal, there is a 100-hour maximum for flight time in any 28 days. Current rules set a limit of 100 hours for every 30 days.
    Yearly: There is a current limit of 1,000 hours in any calendar year for domestic flights. Under the proposal, all types of operations will now be limited to 1,000 hours per 365 days.
    Duty Time
    There is currently a 16-hour duty period between rest periods. The proposal would limit the daily flight duty period to 13-hours, which could slide to nine hours at night (depending on take-off time and number of segments scheduled).

    Background
    Withdrawal of the 1995 proposal
    In order to move forward with a new rulemaking, the FAA formally withdrew the old proposal by publishing a notice in the Federal Register on November 23, 2009. The notice reiterated that the 1995 proposal was outdated and raised many significant issues.
    Fatigue ARC
    On June 24, 2009, Administrator Babbitt announced that the FAA would undertake an expedited review of flight and rest rules. This followed Administrator Babbitt and U.S. Secretary of Transportation Ray LaHood’s June 15 meeting with airline safety executives and pilot unions to strategize on how to best reduce risk at regional airlines. The FAA chartered an Aviation Rulemaking Committee (ARC), which began work in July. The ARC, which consisted of representatives from FAA, industry, and labor organizations, was charged with producing recommendations for a science-based approach to fatigue management. The ARC forwarded its recommendations to Administrator Babbitt on September 9, 2009.
    2008 FAA Fatigue Symposium
    In June 2008, the FAA sponsored the Fatigue Symposium: Partnerships for Solutions to encourage the aviation community to proactively address aviation fatigue management issues. Participants included the NTSB, the Institutes for Behavior Resources, Inc., and many of the world’s leading authorities on sleep and human performance. The symposium provided attendees with the most current information on fatigue physiology, management, and mitigation alternatives; perspectives from aviation industry experts and scientists on fatigue management; and information on the latest fatigue mitigation initiatives and best practices.

    FAA Proposes $547,500 Civil Penalty Against Hawaiian Airlines

    The U.S. Department of Transportation’s Federal Aviation Administration (FAA) is proposing a $547,500 Civil Penalty against Hawaiian Airlines, Inc. for operating a Boeing 767-300 that was not in compliance with Federal Aviation Regulations.

    The FAA alleges Hawaiian operated the aircraft thousands of times when it was not in compliance with a July 2000 Airworthiness Directive (AD) that required inspections of certain engine thrust reverser components. The purpose of the AD was to prevent a portion of the thrust reverser from coming off in flight, which could cause a rapid decompression of the aircraft.

    The AD required initial and repetitive inspections of the components to detect damage and wear, and corrective actions if necessary. It required replacement of the components with new and improved parts within four years of the AD taking effect.

    During a July 2012 inspection, the FAA discovered that some of Hawaiian’s records erroneously showed the AD did not apply to one of its Boeing 767 aircraft. The FAA alleges Hawaiian operated the aircraft more than 5,000 times – mostly on passenger carrying flights – between July 2004 and July 2012 when it was out of compliance with the AD. The FAA further alleges Hawaiian operated the aircraft on 14 passenger flights after the agency alerted the carrier that some of its records erroneously indicated that the AD did not apply to the aircraft.

    Additionally, the FAA alleges Hawaiian failed to keep required records of the status of the AD for the aircraft in question.

    Hawaiian has requested an informal conference with the FAA to discuss the matter.

    Pilot Walks Away After Ultralight Plane Crashed in Maine

    UltralightAn ultralight plane crash-landed in woods off Porter Road, Fryeburg, Maine on the afternoon of August 23rd.

    The single-seater Aerolite 103, flying from Leavitt Airport, New Hampshire, crashed while attempting an emergency landing at Eastern Slopes Regional Airport, Fryeburg, due to engine failure.

    The pilot, a 56-year-old Pennsylvania man, remained unharmed.

    Press Release – FAA Awards $18 Million Environmental Grant to Seattle-Tacoma International Airport

    WASHINGTON – The Federal Aviation Administration (FAA) announced the award of its largest Voluntary Airport Low Emission (VALE) grant for an $18.3 million project at Seattle-Tacoma International Airport (Sea-Tac) to improve air quality and to reduce the use of conventional fuels at the airport.

    With the VALE grant, Sea-Tac will be able to install a centralized preconditioned air plant that will allow aircraft arriving at the gates to shut off their auxiliary power units and connect to a cleaner central heating and cooling system. This project will greatly reduce aircraft emissions on the ground.

    “This program is helping airports around the country make needed technological investments so they can be more environmentally friendly,” said U.S. Transportation Secretary Ray LaHood.

    Since the first VALE grant award in 2005, the FAA has funded 40 projects totaling $83 million dollars.

    FAA Administrator Randy Babbitt announced the grant during a press conference in Seattle where he highlighted environmental efforts under way at Sea-Tac and by the Alaska Air Group (AAG) as examples of the kind of innovative work being done in the aviation community.

    “The FAA is encouraging airlines and airports to find creative ways to reduce aviation’s impact on the environment,” said Administrator Babbitt. “NextGen technology will also help aviation go even greener by significantly reducing the amount of fuel burned during air travel.”

    Administrator Babbitt discussed an innovative program under way in the Sea-Tac area known as the Greener Skies over Seattle project. The project began in early 2009 with the Alaska Air Group (AAG), which includes Alaska Airlines and Horizon Airlines, the Port of Seattle and the Boeing Co. The AAG is seeking to improve efficiency at Sea-Tac through expanded use of NextGen satellite-based technologies to provide more direct and optimized descent paths to landing.

    The program has the potential to provide environmental benefits to the region through reducing fuel burn, emissions, and the number of people impacted by aircraft noise. In addition, lessons and benefits gained from this effort may be transferred to other airports around the nation. In mid-2010 Greener Skies over Seattle became a FAA project and the first phase of Performance Based Navigation instrument flight procedure development is now under way.
