    Airbus Yesterday, Air France Today: Justice Wheels Grind Slowly

    Thursday’s news was that Airbus is being investigated for Air France Flight 447. Airbus officials made a public statement that they “strongly disapprove” of the decision, (no doubt!) but would comply with the investigation. Note to readers: This is law, not option. So let’s take that cooperation with a grain of salt, shall we? When the judge tells you that you’re being investigated, you say, “Yes Ma’am.”

    March 20 is the date the search starts again, more on that below.

    So yesterday, Thursday, was Airbus’s turn in court–
    Today, Friday, Air France has been called in its turn before a judge in France to get its hand slapped. Or get in preparation to get its hand slapped, in ten years or so. Anyway, Air France is also on the mat.

    Or, as they call it in France, (to be purists here) Mise en examen

    This is a criminal investigation. It is a matter of FRENCH LAW. As it was explained to me, “Every air accident is also a criminal matter, and a judge is appointed to oversee the investigation and follow up including charges if any to be filed.”

    So what was the problem with the flight? It crashed. It killed lots of people No one knows for sure why. (Though to some of us it seems obvious.) No black boxes, right? But we’re not idiots. We have plenty of information about what was going on. Not everything, of course, but we have the messages sent by the plane’s computers. They reflect faulty readings which are believed to be the result of faulty pitot tube readings and a series of system failures. We would have a rounder picture of events if the black boxes, which hold crucial information were not misplaced somewhere in the Atlantic. They think they know where it is, (or at least they say they know or say they think they know) based on drift and whatnot (heavy on the whatnot.) But millions have been spent finding this needle in a stack of needles under the ocean, in a submarine mountain range. Nearly 30 million dollars has been spent on the search for the black boxes so far. The cost of the new search is shared by Airbus and Air France and will cost 12.5 million.

    What about the details about the mise en examen preliminary manslaughter charges filed Thursday against Airbus? They were filed in French court by Judge Sylvie Zimmerman over the 2009 deaths of 228 people aboard Air France Flight 447. Fatal accidents automatically prompt criminal probes running concurrent with civil investigations, but a couple of points which may not be obvious to Americans not versed in French Justice are that the charges may be issued pending further investigation, and may hinge on the black boxes which have not been found and may never be found; AND the dual investigation slows things down. That may be one item that delayed the Concord trial 10 years after the accident. You’ve seen pictures of a guy walking around with a tiny ankle-biting dog chewing on the hem of one pants leg? Well, instead of a chihuahua, picture the entire french justice system. Might tend to slow down ones progress, do you think?

    So Air France will be in court Friday, ie today. Watch the news, because what we saw yesterday about Airbus, we’ll see today about Air France. I hope the families are getting some satisfaction from this, because it is going to be a long (long long long) time before they feel like they’re actually being heard, not herded into obscurity.

  • Thanksgiving Wishes

    It is time again for Thanksgiving. In my heart, I feel Thanksgiving every day, perhaps because in my business I am constant touch with families of victims. I work closely with people in all stages of loss. I have to admit, it takes a toll. Even the news of the day takes a toll-the deaths of children abroad in bombings, this bus crash in Tennessee, the latest crash: they all take a piece of me. There are so many times that I can bring hope or help; I can’t help but wish I could always do so. There are so many who have so much. I feel deeply for those who are struggling to get their lives on track, and those who have to scratch for meals wherever they may be.

    As this day of Thanksgiving approaches, I extend my condolences to all those who have suffered loss or deprivation. I pray that this season, everyone has everything they need, peace of heart, peace of mind, and tables full of blessings. At the same time, I give thanks for every moment, for my friends, family and health, and all the blessings of those close to me. Have a happy Thanksgiving.

    The NTSB Sends Two Alerts on the 787 Post Flight Fire in Boston

    First, it does appear that there were two different 787 events at Logan. One was a fire that came about due to overheating and explosion of a battery in a lower bay. Both of the reports below refer to the same event, which grounded the plane. The second event was either a fuel leak or overfueling, which only delayed and did not cancel a different flight four hours while the problem was fixed.

    My criticism is that it APPEARS we are moving too quickly because what is surfacing are minor events that could lead to major events. A battery fire could cause a plane crash, especially on a transatlantic flight. I would like to feel confident that Boeing will easily handle any battery or electrical problem as one of those new plane new plane glitches that one might consider teething. And if this problem “dogs” Boeing shares (as one headline indicates), then better that it dog shares than kill 400 people.

    NTSB INVESTIGATORS LOOKING INTO BOEING 787 SMOKE EVENT IN BOSTON

    WASHINGTON– Investigators with the National Transportation Safety Board are gathering information regarding reports of smoke aboard a Boeing 787 at Boston’s Logan Airport today.

    The Japan Airlines 787 was on the ground and empty of passengers at the time of the incident.

    The NTSB has dispatched an investigator to Boston. Based on a review of the factual information gathered, the NTSB will determine the extent of its investigation.

    NTSB PROVIDES INVESTIGATIVE UPDATE ON BOEING 787 FIRE INCIDENT IN BOSTON

    WASHINGTON – The National Transportation Safety Board today released an update on its formal investigation of Monday’s fire aboard a Japan Airlines Boeing 787 at Logan International Airport in Boston. There were no passengers or crew on board at the time. One firefighter received minor injuries.

    In addition to an investigator already on scene who visually inspected the airplane last night, the NTSB has sent two additional investigators to Boston and formed investigative groups to look at airworthiness and fire and airport emergency response. Senior Air Safety Investigator David Helson has been designated as the investigator-in-charge.

    Parties to the investigation are the Federal Aviation Administration and The Boeing Company. In addition, the Japan Transport Safety Board has appointed an accredited representative and Japan Airlines will assist the JTSB as technical advisors.

    Initial investigative findings include:

    • The NTSB investigator on scene found that the auxiliary power unit battery had severe fire damage. Thermal damage to the surrounding structure and components is confined to the area immediately near the APU battery rack (within about 20 inches) in the aft electronics bay.

    • Preliminary reports from Japan Airlines representatives indicate that airplane maintenance and cleaning personnel were on the airplane with the APU in operation just prior to the detection of smoke in the cabin and that Boston Logan Airport Rescue and Fire Fighting were contacted.

    • Rescue and fire personnel and equipment responded to the airplane and detected a fire in the electronics and equipment bay near the APU battery box. Initial reports indicate that the fire was extinguished about 40 minutes after arrival of the first rescue and fire personnel. One firefighter received minor injuries.

  • Happy Fourth


    It is the Fourth of July.

    Without naming names, I save a corner of my happiness for those countries in turmoil, and peoples of all nations and beliefs–I pray whatever their unhappiness is that it will pass, and they too will know some happiness in their own lifetime, in their own back yards.

    Today, most of the USA will be grilling with friends and family.

    Today we will share the heat, the plenty, the sunshine, the smoke, the food and the fireworks.

    Today from sea to shining sea, we will celebrate our independence—another day, another precious year of this miracle of democracy in this land of unparalleled beauty and diversity. We may argue amongst ourselves, but I hope we can always remember, together, warts and all, we are beautiful. Our lives are the embodiment of a beautiful idea.

    Today I will not think about the pundits who bring us bad news, and focus instead on the story of our country, the miracle that continues. As our lives inscribe another fourth of July into our own history books, let there be another unique page in our story.

    This year, maybe we can invite a few more people to sit at our tables, so more of us can look forward to a well fed today, and a better, stronger, brighter future for our children.

    Today we are still the United States of America, and this is our Independence day.

    I have to reflect on my love of this holiday, but not too long because my family is waiting.

    It’s not the flag waving, it’s what the flag represents.

    I love this holiday because it celebrates our lives. It is a simple thing, really. America is families. Families in our parks, or in our own backyards. A hot dog, a hamburger, a chicken on every grill.

    I love this holiday because this is where our kids play, where they grow strong and free, and spit watermelon seeds. I love this country because my children are free to argue their own opinions, not just about recycling and vegetarianism, but subjects like abortion and political theory. My children are free to be who they are. They are free to dream of who they can be. They are free to reach out and become the dream. Here sons and daughters can both play spontaneous games of touch football, or soccer or tennis or baseball, or compete in potato-sack races or lie on towels in the grass and stare up to count the leaves that twinkle in the sunlight, or the stars peeking out at dusk.

    Tonight I will love this country even more when the babies that cried over fireworks last year will this year gaze at them in wonder.

    Happy Birthday America from sea to shining sea. Have a happy fourth of July.

    Ryanair under the eye of Spanish and Irish Authorities

    What: Ryanair Boeing 737-800 en route from Bristol to Reus
    Where: Barcelona
    When: Sept 15, 2012
    Who: 171
    Why: On Sept 15, the Bristol-Reus flight diverted to Barcelona after developing an engine problem. Passengers disembarked in Barcelona and were provided alternative transportation.

    This is one of the events that caught the eye of Spanish and Irish aviation bodies. They are initializing an investigation into Ryanair after a number of diversions occurred recently in Spanish airspace.

    The investigation was initiated after a diversion to Madrid during a Paris-tenerife flight, and three landings in Valencia on July 26.

    There are fears that Ryanair is courting disaster by flying with minimal fuel requirements.

    Houston Tire Fire

    What: Southwest Airlines en route from New Orleans to Houston
    Where: HOUSTON, TEXAS at Hobby Airport
    When: May 12 Tuesday evening 8 pm
    Who: 47 passengers 5 crew
    Why: When a tire caught on fire after landing at Hobby Airport in Houston Texas, passengers debarked via emergency slide and waited on the runway for transport to the terminal. Several injuries were sustained on the slide. The fire occurred apparently because of a flat incurred on landing.

    I know it’s unfair to pick on airline company that has gone way out on the limb to keep the price of flying low and fair, but, maintenance is a must, there can’t be any cost-savings in maintenance.
