Pilot suspended

A Kabo Airlines Boeing 747 which carried 512 passengers from Kano to make an emergency landing in Sokoto sustained tire damage, deflated tires, and damaged instrument landing systems on landing at Sokoto.

The pilot who flew that plane and made the emergency landing has been suspended.

The Director-General of Nigeria Civil Aviation Authority made the suspension because the pilot failed to obey the air traffic controller’s directive to land on runway 08, but landed on a different runway.

Nigerian Flying Coffins

It is no wonder that Nigerians worry that planes are flying coffins, after the Associated Airlines Embraer crashed on October third. It’s the one that flew the remains of former governor of Ondo State Olusegun Agagu into the ground on October 3, killing 15 people on board. Should I ignore the irony that the passengers of the flight were taking the remains of the governor home when they all joined him in death? It is still too early for the complete analysis of why the plane crashed, but early reports are saying that there was an engine failure that led to the accident.

As the right engine developed problems, the first officer urged Captain Abdulraman Yakubu to abort the flight.

Captain Abdulraman ignored the copilot. He ignored the alerts that the take-off flaps were not activated. The black box indicated the captain was flying.

If he had aborted the flight, the passengers might still be alive. Thirty-one seconds after take-off, the aircraft stalled and nosedived.

But let’s not all jump on the pilot. Because the plane wasn’t airworthy to begin with.
The plane made its last flight on August 30 and had been grounded for about 33 days before the ill-fated flight on October 3, 2013. Someone needs to do their job and, dare I say it again….Maintenance, maintenance, maintenance!

It’s no wonder Nigeria suspended Associated Airlines. “The suspension is to make room for maintenance and operational checks.”

The Director General of NCAA said:
“Associated Airlines operations have been suspended by the NCAA. Let me say for the purpose of clarity, I said their operations, I mean all their operations of Associated airlines have been suspended by the NCAA. I did not say any certification was cancelled but all operations.”

Update on the Associated Jet Crash in Nigeria


On Oct 3, 2013, a twenty-three year old Associated Aviation Embraer EMB-120 was en route from Lagos to Akure to carry the deceased regional governor and family to his funeral in Akure when it crashed, killing 16. Four survivors were hospitalized.

The NCAA said the airline had coverage and the plane’s paperwork and inspections were up to date. The flight data recorder has been recovered.

The son of the late former Governor of Ondo State, Dr. Olusegun Agagu, Feyi, was aboard the plane and survived the crash. The passengers included family members taking the body of Olusegun Agagu, a former aviation minister, to his funeral.

Associated Jet Crash in Nigeria

On Oct 3, 2013, a twenty-three year old Associated Aviation Embraer EMB-120 was en route from Lagos to Akure to carry the deceased regional governor and family to his funeral in Akure.

The Embraer developed engine trouble on take-off. (The failed engine was a Pratt & Whitney.) The plane struck a wooded area, a wall and came to rest on fire, avoiding a residential area. The flight data recorder has been recovered.

The number of people aboard has not been determined. Some sources say the flight had 20 passengers plus a crew of seven; some sources say only twenty were aboard in all. Fifteen victims lost their lives initially, and one died in the hospital.

The four survivors were hospitalized.

Minister of Aviation Summoned to Lagos Hearing on Dana Air crash

The Lagos State coroner is summoning Minister of Aviation, Princess Stella Oduah and a pathologist, Professor Adekunbi Banjo to give testimony in the inquest into the June 3 2012 Dana plane crash. The minister is summoned to appear to observe the coroner in action.
Banjois a consultant with the Accident Investigation Bureau (AIB).

170 people died during the crash, including 153 passengers and residents of Iju-Ishaga.

Banjo is expected to refute claims made Professor John Obafunwa, Lagos Chief Medical Examiner.

Counsel for the Lagos State government, Mr Akinjide Bakare, however, insisted that Banjo ought to have voluntarily made herself available to the inquest, noting that seeking to call her at this late stage was a ploy to delay the conclusion of proceedings.

Dana Air was suspended, then was allowed to start flying again in September.

Then it was recently suspended again Saturday over “safety issues”. On Monday Nigeria’s Aviation Ministry reversed the Saturday decision and Dana Air is air bound again.

100 Dana ground victims demand compensation

More than 100 ground victims are currently demanding compensation for property damage from the Dana plane crash last June. Claims running into billions of naira.

At one point, they were told that the Lagos government planned to take the land to build a memorial to the crash victims. Owners have to provide valid certificates of occupancy to begin the process.

News agencies report that N2.2bn is the total sum to be paid to the relations of the 153 that died in the Dana aircraft but payment information is unverified, and many say their claims have not been satisfied. Likewise unconfirmed is the statement that insurance companies have paid an initial settlement of N418.94m to relations of 85 victims.

Only two relatives have reported they received their “full” settlement.

Bird strike Leads to Emergency Landing at Lagos Airport

On March 28, 2013, a Royal Air Maroc Boeing 737-800 en route from Lagos to Casablanca spent ten minutes in the air after a bird strike on takeoff.

126 were aboard when ten minutes into the flight, there was a bird strike that disabled an engine. The plane circled for about forty minutes to burn off fuel before attempting a return.

Dana Air Suspended-Unsuspended

March 16, 2013, the Nigerian Civil Aviation Authority announced Dana Air’s temporary suspension again. Dana Air had been suspended last June after the MD-83 crash. In January flights were restored.

After a March 16 flight in Abuja had safety issues, leading to a recently grounded flight, Dana Air was again (briefly) suspended.

Med View Emergency Landing, Lagos

On January 27, 2013, a Med View flight was en route from Lagos to Abuja when it developed sudden problems in one engine. Passengers panicked when they heard a boom at 12:30, and the plane began to fly unsteadily.

73 passengers were aboard the twelve o’clock flight that had started fifteen minutes late at Murtala Muhammed Airport.

Pilots shut down the affected engine and made a safe return to Lagos with emergency services on standby.

Apparently pilot and crew made no announcements, but they did handle the emergency and get the plane down safely.

Passengers were provided an alternative flight to Abuja on a 737.

Two not Fatalities of Nigerian Helicopter Crash

A Nigerian Navy Agusta A109E on Ogbia Creek, Bayelsa Nigeria on Dec 15, 2012, 1500 hrs. The Nigerian Navy helicopter crashed in Bayelsa Nigeria that crashed Saturday killed a six including Patrick Yakowa, General Andrew Azazi, governor’s aide, Dauda Tsoho and Warrant Officer Mohammed Kamal who is Azazi’s aide as well as the pilots, Commander Murtala Mohammed Daba and Lt. Adeyemi O. Sowole.

Two entertainers, Ramsey Nouah and Timi Dakolo who were presumed dead were not aboard a helicopter. They missed the charter flight to Oronto Douglas’s father’s funeral.

Nigerian Officials Die in Helicopter Crash

Who: 6 aboard, 6 fatalities
Why: A Nigerian Navy helicopter crashed in Bayelsa Nigeria. Among the fatalities is the governor of Kaduna, Patrick Ibrahim Yakowa.

Several politicians had traveled to Bayelsa for the funeral of the father of Mr. Oronto Douglas, the President’s Special Adviser on Research and Documentation.

Also aboard was former national security adviser Gen Owoye Azazi. The rest of the casualties are governor’s aide, Dauda Tsoho and Warrant Officer Mohammed Kamal who is Azazi’s aide as well as the pilots, Commander Murtala Mohammed Daba and Lt. Adeyemi O. Sowole.

The helicopter crashed five minutes after it took off, between 3:30 and 4 pm around Nembe-Okoroba area. Witnesses say the helicopter nosedived, then was a crash, and the chipper burst into flames. There was a big burst of black smoke.

Search and rescue operation was performed by a combined team of personnel from Joint Task Force (OPS PULO SHIELD), Nigerian Navy, Nigerian Air Force, NEMA and Nigerian Security and Civil Defence Corps. The remains have been taken to Yenagoa, Bayelsa State capital.

Another chopper with registration number 5NBOR carried other aides and security details to Port Harcourt without incident.

The crash is under investigation.

Stowaway Found in Arik Air Wheel Well

What: Arik Air Airbus A340-542 en route from London to Lagos
Where: Lagos Murtala Muhammed International Airport

Who: 1 fatality
Why: The body of a man was discovered in the wheel well of an Arik Air Airbus after a flight from London to Lagos. The body had no identification. There is no indication how long the body remained there, nor where it came from.

According to officials the body was discovered “during a check on the aircraft panel as it was being prepared for another flight and that the undercarriage compartment of the Airbus A340-500 is big enough to accommodate a person, besides the space for the tires.”

Security at Lagos Murtala Muhammed International Airport is reputed to be lax, and authorities have apparently been ineffective in eliminating illicit activities.

Emergency Landing in Lagos

What: Aero Contractors flight en route from Lagos to Abuja

Why: After take-off, one of the engines quit.

The pilot was in the air less than twelve minutes, and returned to Lagos to make a asafe landing at the airport. The problem was corrected as not an engine failure but an apu failure.

Repairs were made to the plane which is now apparently operational.

Fokker Flight Delay after Runway Fender Bender

What: IRS Fokker 110 en route from Lagos to Abuja
Where: Lagos
When: Oct 10, 2012
Who: 91 passengers
Why: The right wing tip of a taxiing Fokker struck a glancing blow to a sewage tanker truck, damaging the plane’s wing.

The truck is being extracted from the drainage ditch where it was stuck.

A replacement jet was provided for passengers, although the Fokker’s wing damage was reported to be nominal.

N36 Million Awarded to Families of Police Chopper Crash Victims

The families of late DIG Haruna John, AC Garba Yalwa (Pilot), CSP Alexander Pwol-Ja (co-pilot,) and Sgt Sonatian Shirunam (orderly to the DIG) were given bank cheques of the insurance covers ranging from N9 million to N2 million by Inspector General of Police Mohammed Abubakar.

Four property owners who sustained damages were awarded compensation.

Why: On approach to Lagos, the pilots declared emergency over a landing gear problem.

David Disiere Southlake Aviation Awarded $32-Million Damages in Congo Gold Smuggling Case

In a civil trial that sounded like a real life James Bond spy novel, a Dallas County Jury awarded Southlake Aviation, owned by Dallas business executive David Disiere, $32.4 million in damages against Houston based oil company, CAMAC International, its subsidiary CAMAC Aviation, and Mickey Lawal CAMAC’s Vice President of African Operations.
The case stemmed from a scheme in which CAMAC International and its officers used a Gulfstream V jet leased from David Disiere’s Southlake Aviation to try to spirit more than ten thousands pounds of gold bullion out of the Democratic Republic of the Congo with help from General Bosco Ntaganda, a notorious Congolese warlord.

Following the verdict, Southlake Aviation’s President, David Disiere praised the jury’s decision, “twelve citizens saw through a smoke-and- mirrors defense put on by the CAMAC’s attorneys and clearly found that CAMAC caused my company to loose a $43 million dollar aircraft in a greedy scheme that violated the U.S. Trading With The Enemy Act.”
The jury heard riveting testimony from a diamond trader involved in the scheme describing how CAMAC executives Kase Lawal, Mickey Lawal, and Kamoru Lawal arranged to exchange two-oversized suitcases stuffed with six-and-half million dollars in cash for ten boxes of gold delivered by General Bosco Ntaganda’s armed forces.

An investigation of the smuggling incident by the United Nations Security Council found that CAMAC and its three top executives, Kase Lawal, Mickey Lawal, and Kamoru Lawal were dealing with “individuals operating in the Democratic Republic of the Congo and committing serious violations of international law involving the targeting of children or women in situations of armed conflict.”

Kase Lawal, Mickey Lawal, and Kamoru Lawal who are Nigerian American brothers invoked their Fifth Amendment right against self-incrimination hundreds of times during their testimony in the case.

Houston energy executive, Kase Lawal the former CEO of CAMAC International and the current CEO of the publically traded CAMAC Energy Inc. was appointed to a White House Trade Advisory position by President Obama and serves on the boards of the Houston Port and Airport Authorities.

David Disiere, the Dallas business executive and owner of Southlake Aviation, told the jury how he was shocked to get a call in the dead of night informing him that his company’s 43-million dollar Gulfstream V jet aircraft loaded with ten boxes of gold had been confiscated in Goma by authorities in the Democratic Republic of the Congo on February 5, 2011. The jury’s verdict also included compensation of more than 535-thousand dollars for repairing damage done the to the aircraft’s interior passenger compartment during the loading of the gold.

Because Southlake Aviation’s aircraft was confiscated in the Congo, VFS Financing a subsidiary of General Electric, automatically placed Southlake Aviation’s loan to purchase the Gulfstream V in default, accelerated the entire balance, and repossessed the aircraft.

Testimony in the case and the investigation by the United Nations also indicated that former Houston Rocket’s basketball star Dikembe Mutombo acted as an intermediary in the gold smuggling scheme.

Testimony in the case showed that David Disiere had never met the Lawal brothers. Disiere testified that CAMAC had signed a three-year lease for Southlake’s Gulfstream V jet and claiming it would use the jet was to travel between its Houston headquarters and oil operations in Nigeria.

The jury agreed with David Disiere’s testimony that CAMAC and its officers violated the terms of the aircraft’s lease by using it in an outlaw region of Africa.

Foreign Airliner Leasing & Financing Un-Deserving Operators

Arik Air Ltd., and Aero Contractors Co. of Nigeria Ltd., Nigeria’s top two airlines, have been banned from getting loans by Nigeria’s Central Bank due to the massive debt they have accrued. Arik Air owes Asset Management Corp. of Nigeria more than $534 million. Aero Contractors owes more than $203 million. A bank that loans money to these airlines will face “serious fines from the government.” Air Nigeria recently collapsed owing crew a debt of four months’ pay, in addition to $175 million in loans to Nicon Investments Ltd..

Only three Nigerian airlines remain in operation. Arik Air has not published a date when it will resume flying.

Officially, according to the BBC, the carrier resumed domestic flights on Sunday Sept 24. However we did get anonymous input from Monrovia that as of Saturday, Sept 22nd, Arik Air was flying.

Before making a loan, banks need to look past the uncertainties in airline survival, aircraft value, interest rates and the airline’s credit worthiness.

This is what the aircraft leasing companies should do:

Stop leasing planes to operators that are careless in their maintenance and pilot training.

Leasing companies should not look only at credit worthiness. Yes, that is one factor, but it is only part of the picture. Leasing companies must also make judgements based on the history of the airline operator performance, and maintenance.

If credit and performance history all checks out, the oversight is not over. The leasing company should monitor every single plane they have leased out to foreign operators.

If monitoring reveals any problems whatsoever, that pilots are not being trained, that they are not getting enough sleep, that the operator or aircraft goes on a black list, that the operator is shown to be negligent in any way, then the lessor should endeavor immediately to pickup/repossess that plane.

Maintaining every aspect of the plane’s maintenance, flight operations, crew resource management, and crew training is as crucial to the contract agreement as payments. Failure to keep everything up to date is as much a breach of contract and cause for action as is failure to pay.

Why: NAICOM told seminar attendees that the $70,000 per Dana Plane Crash victim payment is contingent on the death certificate and letter of administration, and 70 per cent of Dana Air Crash Claim settlements have been delayed due to families being unable to submit death certificates and letter of administration.

58 families have been paid $30,000 (the initial 30%) that is due 30 days after the crash. On verification of the correct claimants, the balance of the claims should be covered by Prestige Assurance, six Nigerian insurance companies and Lloyds and Lloyds Associates.

On August 9, 2012 at Lagos State University Teaching Hospital, two months after the June 3, 2012 crash, after that all possible DNA testing was complete (only 52 of 149 bodies identified, the rest burnt beyond testability,) the Lagos Government announced that it would release bodies of Dana crash victims to the next of kin.

Families were requested to contact the Funeral Director’s office on 01-8542254 at the teaching hospital 24 hours before they come to claim the bodies.

One family trying to claim their loved one, Mr. George Moses, found he is missing. He was #22 on the list of 29 identified names at the Lekan Ogunsola Memorial mortuary in June. Mr. Achief Olajide, a family member said that after the June 3 crash, he saw Moses intact body, his ID card and wallet. The mortuary refused to let him claim the body, and now it is lost.

Dana Air History Comes Out at Inquest

While testifying at the coroner’s inquest before Lagos State Coroner Mr. Oyetade Komolafe, Tony Usidamen of Dana Air revealed that the Dana plane (registration number 5N-RAM) that crashed in Lagos in June 2012 had its engine replaced after a bird strike while outbound from Lagos on April 19, 2010.

Records indicate 5N-RAM also had hydraulic leaks on May 23 at Murtala Mohammed Airport.

On the June 3rd, the plane was making it’s third round trip and crashed close to it’s destination airport.

The Accident Investigation Bureau (AIB) investigator is Mr Emmanuel Dialla. His preliminary report said that the first sign of trouble came 17 minutes after the plane was airborne at 2.58pm, following a “non-normal” engine condition. According to the CVR at 1543:27 hours (3.43pm), the Captain informed the FO, “we just lost everything, we lost an engine. I lost both engines”…

On taxi, wings of Nigerian Airforce C-130 and Arik Airlines Collide, No injury

Why: The jet was about to take off when “An Arik Airline Boeing 737-700 with registration No 5NMJI on a routine flight to Lagos brushed the wing of a parked Nigerian Air Force C-130 (NAF 917) at the Yakubu Gowon Airport.”

The tank 1 wing tip of the NAF C-130 was damaged. The wing of the Arik aircraft was dismembered.

The announcement was made by Wing Commander A. Makun, Deputy Director, Directorate of Airforce information.

The Air Force Jet was about to fly Airforce Military School and Airforce Girls Military School both in the Plateau State capital from Jos to Lagos. The flight was canceled.

Why: According to the Dana Crash Preliminary report, the captain and the first officer were in a discussion of a non-normal condition regarding the correlation between the engine throttle setting and an engine power indication. They did not voice concerns then that the condition would affect the continuation of the flight.

The report included records of visual examination of the aircraft wreckage, review maintenance records and other historical information of the aircraft, documentation of the training and experience of the flight crew, determination of the chronology of the flight, review of recorded data, reconstructing the aircraft refueling, and collection of related fuel samples and interview of related personnel.

Dana Air Interim Payments Offered

Why: Dana air stated that it is fully aware of the mandatory requirement by the International Civil Aviation Organisation (ICAO) and the Nigerian Civil Aviation Authority (NCAA), for interim benefits to be paid to the families of the victims within 30 days of the accident.

Although 68 families have completed their insurance compensation documentation, only nine families were given $30,000 each, having been the only ones to successfully run the legal gauntlet.

Beneficiaries said the interim payment fell short of their expectations.

Claim forms must be taken to Yomi Oshikoya & Co, for verification. Yomi Oshikoya & Co was appointed by the insurers in Lagos.

Dana Air attempted to distribute cheques as interim compensation to some individuals made homeless by the crash. Dana Air prepared N500, 000 for one of the victims, Mr. Daniel Omowunmi, N100, 000, each to two occupants of the boys’ quarters and N200, 000 each to six families in the block of flats. Full payment of the compensation by the insurance company is pending. The lawyer rejected the checks as inadequate and also not all of the victims were included.

Nigerian Aviation Under Scrutiny

The numbers for the Dana Air crash may be as high as 222: 153 passengers and crew and a possible 69 ground casualties. The Voice of America puts the Nigerian death toll from 110 recorded crashes since 1943 with a total of 1500 fatalities. AllAfrica puts that number at 162 fatalities and 16 crashes.

Can we say there has been improvement when there were three crashes in 2005-2006 that killed a whopping 320 people? Regardless of the exact recorded figures, the list of Nigerian plane crashes makes a long, sad story. Carriers have a history of financing problems or corruption.

Prior to Dana Air, the last big crash was Oct. 29, 2006, when an Aviation Development Co. flight from Abuja to Sokoto crashed, killing 96 people after two minutes in the air. There was also the Bellview Airlines Crash in 2005, and Sosoliso Airlines–a plane full of children.

On Wednesday Nigeria’s Federal Executive Council established a nine-man Technical and Administrative Review Panel headed by Group Captain John Obakpolor to “determine the remote and immediate causes of the crash.” But here’s the problem–studies have already been made, and findings found. But where is the implementation of concrete reform?

Is Nigerian aviation industry in a tailspin? We can only hope that progress is being made in this country where governmental corruption has rendered airline regulation ineffective. We have seen time and again in aviation safety, when corners are cut, lives are lost.

After looking at the November 2006 ICAO audit here, we can only hope that Nigeria will redouble its efforts at aviation safety reform.
