    FAA Focuses on Fixes to Aircraft Collision-Warning Systems

    After looking back at near-collision data the FAA collected, the FAA has given U.S. airlines three years to install software changes to collision-warning systems, saying that the warning devices that have been installed in commercial airliners as well as private businesses need to be fixed.

    The FAA has known since 2009 that systems have been known to fail to monitor and track all the nearby planes, resulting in monitoring errors, a fact which could and may have already caused problems in 7000 commercial planes and 1800 business planes in the US.

    If a warning system fails, and is known to fail, why is a crash which may have been the result of a warning system failure being attributed to air traffic controller error or pilot error? That’s what I’d like to know. Do we need to be looking more closely at L-3 Communications?

    Diligent Kudos to AeroMexico for Averting a Disaster

    What: Aeromexico Boeing 737-700 scheduled from Costa Rica to Mexico City
    Where: Costa Rica
    When: Mar 12, 2011
    Who: 2 (drunk) Mexican pilots, 101 passengers
    Why: Saturday on arrival at the airport in Costa Rica for their shift, these two AeroMexico pilots complained of nausea. They probably had big heads too, since they had attended some kind of drunken revelry 7 hours before in San Jose, which is not long enough for the alcohol to be metabolized out of their systems. They were apparently intending to fly their shifts, but some eagle-eyed AeroMexico personnel correctly evaluated their condition. One of them refused the alcohol test, but not the other. Neither was allowed to fly, and both were suspended. The flight was delayed until replacement pilots (sober ones) were found to take the cockpit. Passengers were compensated for the delay.

    Is March the month for drinking? A case was just brought to our attention yesterday, and though it is not aviation, it is frighteningly similar, though I could argue they were completely different. But then, I could argue anything even if I’m not a lawyer.

    The case I’m talking about is that of the BOLT Driver Arrested for DUI. Bolt is not an airline, but a bus division. So what is the similarity? There it was bussing (trucking) down the road when it was pulled over and the driver cited for tailgating, and driving in the wrong lane before he got his driving under the influence AND his license taken away. He was caught, sadly, not before his shift, and not by crew, but by passengers who clearly feared for their lives and called 911 from inside the bus, as the driver was either weaving, or napping or drinking, or all of the above. Someone had seen his pocket flask.

    Okay, the obvious similarities are drunks at the wheel of communal transit. Both were caught before serious damage occurred. The difference—and this is crucial—are that the BOLT bus driver was allowed to take his shift, regardless of his condition. He put everyone aboard that bus at serious risk.

    So kudos to AeroMexico. Even though all you’re going to hear about it is grousing from individuals complaining of the delay, your diligence probably saved the lives of 110 passengers.

    Identificação de DNA no caso do voo 447 da Air France. Ótimo… agora vem a Escolha de Sofia.

    Para aqueles que podem estar lendo isso em outro idioma, cabe explicar a expressão Escolha de Sofia. A expressão tem sua origem em um romance de mesmo nome, escrito por William Styron, no qual a protagonista, Sofia, é uma mãe forçada a fazer uma escolha impossível: cabe a ela escolher entre a sobrevivência de seu filho ou de sua filha. Não lhe é permitido escolher a ambos, com o sacrifício de sua própria vida (o que seria a escolha da maioria das mães). Caso se recusasse a escolher, os dois morreriam. Por isso, a expressão ‘escolha de Sofia’ tem sido aceita na cultura americana como um paradigma da escolha impossível.

    É a mais expressão mais apropriada para nossa atual situação.

    Segundo os relatórios da polícia, testes laboratoriais bem sucedidos extraíram amostras viáveis de DNA do tecido de aproximadamente 50 corpos de vítimas do voo 447. A extração comprova que o DNA pode ser utilizado para se identificar os corpos.
    Entretanto, no início da semana, dois juízes parisienses encarregados dos resgates, Sylvie Zimmerman e Yann Danielle, decidiram, com relação aos restos mortais, que “com o fim de preservar a dignidade e por respeito aos familiares enlutados, os restos das vítimas que estão muito degradados não devem ser recuperados. Apesar de terem sido realizados testes nos dois corpos recuperados, com o fim de checar a possibilidade de identificação, nenhum outro deverá ser içado”.

    Muito embora os juízes tenham decidido que os corpos não devem ser retirados do mar por isso ser muito traumático para as famílias, há familiares que desejam ver seus entes queridos resgatados. Por isso, não ficaremos surpresos se tal decisão for contestada por familiares que considerem ainda mais traumático deixar aqueles que amam no mar; ainda mais agora, quando estão tão perto.

    Pode ser que tal decisão não tenha sido definitiva, mas significou que os resgates podem ser suspensos após a realização dos testes.
    Apesar de o presidente da associação de familiares, Nelson Marinho, ter dito que “essa operação traz muita esperança às famílias, que agora têm alguma expectativa de encontrar os corpos de seus entes queridos, a fim de lhes dar um funeral adequado”, parece que alguns familiares não querem ter de enfrentar as presentes condições dos corpos.

    As famílias e os juízes logo enfrentarão uma escolha de Sofia.

    O assunto não seria um problema se:

    – os corpos estivessem localizados em um lugar de fácil acesso, de onde não fosse difícil recuperá-los;
    – todas as famílias concordassem;
    – os testes pudessem ser realizados rapidamente, sob a água e de imediato;
    – se os restos estivessem em melhores condições.

    Mas nada disso é verdade. Os corpos estão em um lugar obscuro e não ficarão lá por muito tempo, a não ser que algo seja feito para protegê-los. Se não forem recuperados agora, serão provavelmente perdidos para sempre.
    As famílias têm opiniões e necessidades distintas. Algumas se encontram transtornadas com o trauma dos resgates, porque os fatos recrudescem o sofrimento iniciado há apenas dois anos. Outras têm alguma esperança de que um funeral normal ajude a encerrar o episódio. Sem dúvida, há aquelas que têm sentimentos profundos, mas não conseguem decidir entre recuperar os corpos ou deixá-los no mar.

    Os testes de DNA devem ser feitos em laboratório, levam tempo, e significam que, para uma analise mais precisa, os restos precisam ser recuperados para identificação. E, depois de dois anos imersos em água salgada, sob a mesma pressão suportada pelas caixas pretas, os corpos, que já não se encontram em boas condições, ficarão ainda mais deteriorados com o resgate.

    Qualquer que seja a decisão, lembremo-nos de que a lei não é imutável, mas algo vivo. Esperemos, pelo bem das famílias, que aqueles que se sentem aptos a julgar as escolhas dos outros optem, neste caso, por favorecer os desejos de cada família, em vez de se tornarem um obstáculo.

    As famílias já sofreram o suficiente.

  • In Jamaica, Half a Runway is Better Than None, Mon…

    One thing I feel is that someone out there in aviation (and I don’t know who it is)-the pilot in general, ATC, or the airline-does not respect Mother Nature. Weather happens. Sometimes very BIG weather happens. And people will just not be dissuaded by a little common sense. No matter what, if we want to go, we’re going to jump on our magical Boeing-Airbus-Embraer-McDonnell Douglas Sleigh like Santa Clause, the Postal Service or Fed Ex, and we will go. People want it, so the airlines are going to provide it, like the inscription on the James Farley post office in New York “Neither snow nor rain nor heat nor gloom of night stays these couriers from the swift completion of their appointed rounds.” Or to more-or-less paraphrase David Farragut, “Damn the lightning, full speed ahead!”

    So my first point is that we should respect nature a little more. Sometimes discretion is the better part of valor.

    We commonly make assumptions here in all of our posts, because we’re using a who/what/where/when format. The “What” usually ends up as a synopsis of events, with just a little bit of why thrown in. But “why” is not a question we can take lightly. “Why” an incident happens is just too big for us to cover, especially since we try to get our posts up within hours of the event. Between you and me, if it takes a year for the whole NTSB research team made up of a federal building full of highly educated and experienced experts, thousands of pages of recorded documentation, video and concrete evidence, and the nation’s keenest analytical minds juggling all the permutations to figure out “why” a crash happened, then we don’t really think we can come up with the perfect “why” off the top of our heads fifteen minutes after the crash.

    That said, there’s an expert in Jamaica–Lt. Col. Oscar Derby, director general of the Jamaica Civil Aviation — who says that the aircraft touched down at 4,100 feet (assuming this is fact, since one can assume the director general of Jamaican aviation has access to all the facts) and that number isn’t referring to altitude, it’s referring to the plane’s wheels contacting mother tarmac halfway down the runway. I’m not going to talk about his decisions, or his inquiry because it is simply too soon.

    But if the plane landed halfway down the runway (if it is not internet gossip, but a fact that the plane did land halfway down the runway)…that is significant. It probably wouldn’t matter if the plane hadn’t bounced. Or if it hadn’t been raining. Or if the plane hadn’t hydroplaned. But ALL of those things happened too.

    I don’t know why the pilot landed halfway down the runway; but I do know there is always some point of no return where the pilot must commit to either fly by or land. I don’t know the factors that came into play with this pilot, on this day, on this runway, during this storm that affected the decision. Experts will be spending years looking at this pilot’s split second decision.

    The fact remains that in a harrowing rainstorm, after a turbulent flight, a bounce on landing, and hydroplaning, the American AIrlines crew still managed to come out of it with everyone aboard alive, and that is a job well done.

    Airborne Cell Phones In Legal Eye

    To phone or not to phone, that is the question. Or to update it a little:
    Do radio signals from cell phones disrupt key airplane functions?

    OR

    Are current U.S. cell phone bans outdated and useless at promoting air safety?
    That is today’s question.

    In U.S. air space, cell phones are banned, but all European carriers do not ban cell phone use.

    The U.S. Federal Aviation Administration says cell phones may emit signals that can affect aircraft communications, navigation, and flight control.

    There’s some piggyback legislation in the FAA reauthorization bill that would prohibit cell phone use on planes by anyone other than flight crews or law enforcement. Currently once planes reaches 10,000 feet it is up to the carrier to allow or disallow passengers to turn on most portable electronic devices except cell phones.

    Boeing, for example, prohibits the use.

  • Thoughts on Human Error

    Humans are amazing inventors, capable of envisioning a “possible” for every “impossible,” creating incredibly complex feats of engineering, in the name of Hughes and Learjet and McDonnell Douglas and Lockheed and a hundred others whose names won’t be forgotten. Even amazing inventors can engineer lemons, or fail to see every possible contingency. But the possibility of error goes beyond human error. Humans are not responsible for the fact that rust exists. Do you blame Einstein for the fact of relativity? It’s the dichotomy of reality: for every up there’s a down. Everything creates its own opposite. “Fixed” allows the possibility of “broken” to exist.

    Thinking logically along those lines…we can speculate and plan, study and test, polish and revise, but does that make our planning and scheduling invincible? Even if it were perfect (and I’m not saying it is, because I am speaking of things in general), things fall apart. The nature of reality is change. Change happens. Plan for contingencies 1-3000 and the one that will happen is contingency # 3001.

    We have to be careful sometimes when we start talking about human error. Unfortunately the container where the human error begins is life itself, because in theory EVERY thing can be blamed on human error. The patient died, blame the doctor. Nevermind that the patient was 112 and suffered every illness known to man.

    In aviation, gunnysacking the humans happens too. Maybe they didn’t cause the lightning but they flew through it. We humans are pretty amazing creatures but we don’t control nature. We can plan and schedule all we want, but if you are going to fly during rain, you’re going to encounter thunderstorms. So let us say that the storm is responsible for the event. Do we blame the pilot for flying through the storm? Do we blame the arrogance of the plane manufacturer who claims the plane is invincible and can fly through anything?

    Pilots are human. We have the full range of the spectrum, from the sublime, Sully, to the ridiculous (Colgan Air’s Marvin) Renslow. The problem that a hero like Sully presents to the rest of us is that he creates the philosophy that well trained pilots should be able to solve any emergency.

    But take for example Air France 447… could the pilots have been able to cope with flight speed problems caused by the performance of flawed parts?

    Is the failure to recover from an unexpected event (wind shear, potential conflicts with other planes, broken planes) pilot error? If we put human beings in an easy chair of an automated job in some point-and-click fly-by-wire captain seat, when the crisis happens, the built-in redundancies in flight systems fail and the pilot can’t snap out of humanness to turn into Superman when the wire breaks, is that pilot error?

    Our pilots now have to deal with cost-cutting industry practices causing fatigue and poor training.

    Even if the ultimate safety device in the airplane is the well-trained pilot, guess what? Pilots are human. Humans are capable of mistakes. They are capable of mistakes when operating planes.

    Let us not forget that pilots fly planes that were crafted by humans, maintained by humans, orchestrated by human ATC, landing on airports designed by humans.

    There is no one single answer. I have seen it a hundred times, and each case is unique unto itself, with one generality that can apply.

    Human error occurs at all levels, and rarely alone.
