    FAA proposes $275,000 civil penalty against Continental Airlines

    For Immediate Release
    December 22, 2010

    SEATTLE– The Federal Aviation Administration (FAA) is proposing a $275,000 civil penalty against Continental Airlines Inc., of Houston, for operating two Boeing 737-900ER (extended range) aircraft on 73 flights when they were not in compliance with Federal Aviation Regulations.

    The FAA alleges Continental mechanics failed to follow the 737 Airplane Maintenance Manual when they installed incorrect main landing gear wheel-tire assemblies on two aircraft and released them for service on Nov. 7 and 19, 2009.

    The manual contains specific instructions to mechanics not to use wheel-tire assemblies intended for the B-737-700, -800 and -900 on the heavier B-737-900ER. The manual says using the incorrect assemblies on the heavier version of the B-737 might lead to damage to the aircraft or injury to people working on and around the aircraft.

    Continental has 30 days from receipt of the FAA’s enforcement letter to respond to the agency.

    FAA Needs To Improve Risk Assessment Processes For Its Air Transportation Oversight System

    On December 16, 2010, we (the FAA) issued our report on the Federal Aviation Administration’s (FAA) Air Transportation Oversight System (ATOS). FAA uses ATOS to conduct surveillance of nearly 100 airlines that transport more than 90 percent of U.S. airline passenger and cargo traffic. While ATOS is conceptually sound, our prior reports have found that FAA needs to strengthen national oversight of the system. Following safety lapses at a major airline in 2008, the Senate Committee on Science, Commerce, and Transportation and the House Committee on Transportation and Infrastructure asked us to assess weaknesses systemwide. Accordingly, our audit objectives were to determine (1) whether FAA has completed timely ATOS inspections of air carriers’ policies and procedures for their most critical maintenance systems; (2) how effective ATOS performance inspections have been in testing and validating that these critical maintenance systems are working properly; and (3) how well FAA implemented ATOS for the remaining Part 121 air carriers and what, if any, oversight challenges FAA inspection offices face.

    While FAA has worked to continuously improve ATOS, we found that FAA inspectors did not complete ATOS inspections of air carriers’ maintenance policies and procedures or systems performance on time. In addition, FAA transitioned all of its Part 121 inspection offices to ATOS at the end of 2007, but–due in part to training gaps–some inspectors for smaller air carriers had difficulty adapting ATOS to those carriers’ operations. We made seven recommendations to FAA to improve its data, training, and risk assessment processes for ATOS. FAA concurred with four of our seven recommendations and partially concurred with three.

    Safety Tip – Airport Surface Deviations

    Ground Operations
    As winter gets into full swing across the country we should be aware of its impact on our surface operations at the airport. Operating on a snow or ice covered surface — either in a ground vehicle or an aircraft — requires an extra degree of caution. Movement of ground equipment should be done in a manner that allows you to avoid sliding or skidding into other equipment or aircraft, or skidding across hold lines.

    Extreme caution also is needed when towing an aircraft due to the added weight and the fact that most of the time you are relying solely on the braking action of the tug to stop both the aircraft and the tug. On wet, slick or icy surfaces the aircraft in tow can suddenly jack knife out of control as you turn or attempt to stop.

    The same cautions must also be adhered to when taxiing an aircraft in these conditions. When diminished braking action is present, aircraft can slide off taxiways and runways if one is not careful. When approaching hold lines and turns, be sure to use minimal speed to ensure your ability to come to a stop prior to the hold line or to avoid skidding off the taxiway during a turn.

    As with all ground operations, keep your eyes outside the cockpit while taxiing and adhere to all ATC instructions.

    Harrison Ford

    Wright Memorial Dinner

    Good evening, and thank you, Lisa [Piccione]. I’ve got to tell you … I had to resist the go-to move to, in the interest of safety, to spend some time talking about why doing “Indiana Jones” style stunts in an airplane would be a really, reallybad idea.

    But that’s not what tonight is all about. We’re honoring a pilot, a man who in spite of being a very well known celebrity has used his passion to serve as a springboard for aviation. Even in this room, Harrison Ford’s passion for aviation stands out. When he and I met and talked at a fundraiser at Oshkosh a few years ago, I learned pretty quickly that this is somebody who just loves aviation. Here’s a guy who is on Hollywood’s speed dial, and he wants to talk about hisidea of fun… which is actually a two-parter: flying, or talking about flying.

    In my book, he’s very clearly a student of the craft. Our system is as good as it isbecauseof him and people like him. There’s no special setting for pedigree on the yoke. You have to know your aircraft, and youhave to make sure that you’re both current and qualified when it comes to flying it.

    The good news here is that is exactly what we find in Harrison Ford. I’ve been flying now for almost five decades myself, and after a while you learn that you really can separate the ones that have it from the ones that don’t… Well, trust me, he’s got it.

    There’s a hangar in Santa Monica that shows he’s got it bad for things that fly. Fixed wing and rotorcraft rated. Walk in that hangar, you’ll find a Bell, a Beaver, a Husky, a Bonanza and a Caravan. He’s a one-man air show. That’s the inventory of someone who is a student of aviation.

    But I must tell you, that list of aircraft takes a back seat to what he has given toour industry. As chairman of the Young Eagles, he has been instrumental in giving our youth their first taste of aviation … their first flight. In his case, the word “chairman” was not a ceremonial title. You might expect that as chairman, he might have flow a fewyoungsters by himself. But you know what? He’s actually flown 306 … to be exact. That’s right kids; Han Solo is the pilot in command. Except you can bet those kids didn’t want to be Han Solo. They wanted to be Harrison Ford, the pilot.

    We’re always looking to ways to boost aviation… to inspire the next generation into aviation, especially to the youth of America. Here’s a guy who does it. We’re all about getting more science, more math, more engineering into our school curriculums. With aviation, you can do all three in with just a barrel roll or two. Wall Street can have Michael Douglas. We got Harrison Ford. Score one for aviation.

    Harrison has also been an outspoken advocate for aviation safety. He’s spoken up about runway incursions and airborne turbulence. His ticket shows me enough ratings to know that he’s not casual about aviation … he’spassionate. And when I talk about professionalism, I’m talking about the man we’re honoring here tonight.

    He has given much to aviation, but his legacy will be as a pilot… as an advocate… as a man whose passion is to enjoy the cockpit view of the horizon … and to give others a chance to do the same. And thatis a very fine legacy and certainly worthy of the honor he’s receiving tonight. Thank you.

  • FAA Safety Briefing article Between a Rock and a Hard Spot

    Handling an engine failure inflight is something all pilots are trained to prepare for early on in their careers. But as author and Master CFI Doug Stewart points out in his FAA Safety Briefing article, “Between a Rock and a Hard Spot,” handling a partial power take-off can complicate even a well-rehearsed mitigation strategy. Stewart offers a personal account of a “lessons learned” moment in his Cessna Cardinal RG when he found himself on the back side of the power curve on takeoff, and with trees closing in fast.

    “My best techniques were not enough to overcome the fact that we did not have the power—or airspeed—to climb fast enough to clear the pine trees,” said Stewart. Learning from his experience, Stewart now realizes a ground roll and obstacle clearance calculation would have led him to the correct decision of aborting the flight. “That choice might have led to some damage to the airplane, but it would have kept an abnormal airspeed indication from developing into a life-threatening emergency,” Stewart added.     SAFO: Maintenance of Night Vision Imaging Systems (NVIS)

    Purpose: This SAFO alerts operators of aircraft equipped with a Night Vision Imaging System (NVIS) of
    potential deficiencies in the configuration and condition of installed NVIS equipment.

    Background: Recent Federal Aviation Administration (FAA) assessments of NVIS-equipped aircraft have shown that the likelihood of configuration and maintenance problems increases as aircraft continue in service after NVIS modifications. This means that operators of NVIS-equipped aircraft may not be adequately meeting the inspection and maintenance requirements of NVISs.

    The assessment also concluded that operators are installing light-emitting or light-reflecting equipment, which affects the NVIS compatibility of the aircraft, without ensuring that the equipment is properly evaluated.

    Discussion: The FAA’s Aviation Safety (AVS) organization recently directed a nation-wide sampling of NVIS- equipped aircraft. FAA teams, made up of Flight Standards Service (AFS) inspectors and Aircraft Certification Service (AIR) inspectors/engineers, conducted the sampling and discovered that NVIS-equipped aircraft were frequently out of compliance with NVIS requirements for three primary reasons:
    ? Operators installed light-emitting or light-reflecting equipment that caused the aircraft to no longer be properly configured for use with Night Vision Goggles (NVG);
    ? Operators failed to properly maintain the installed NVIS equipment; and
    ? Flightcrews were aware of conditions that reduced the ability to see necessary instruments/equipment during day, night, NVG-aided, or NVG-unaided flights. Another common problem was improperly filtered light-emitting equipment. Flightcrews did not communicate these discrepancies to the maintenance department or maintenance personnel.

    After assessing and analyzing the data collected, the FAA has determined it is likely that other NVIS-equipped aircraft may not be properly configured or maintained for NVG operations. The term night vision device was intended to include all necessary equipment that is installed or modified as part of the entire NVIS, which includes NVGs. Failure to properly maintain an aircraft’s NVIS configuration and equipment can degrade NVG acuity (i.e., blind spots for flight crewmembers using NVG) and prevent the flightcrew from clearly seeing aircraft instrumentation.

    Recommended Action: Directors of Maintenance, Directors of Safety, Directors of Operations, Chief Pilots, mechanics, and pilots operating or maintaining NVIS-equipped aircraft should take appropriate action to confirm the following:
    1. Instructions for Continued Airworthiness (ICA) are current, correct, applicable by serial number, and are being properly applied by maintenance departments and personnel. If the ICA has been incorporated into an inspection program, confirm that all the additional ICA requirements are being met;
    2. Installed NVIS equipment are properly maintained;
    3. Maintenance personnel are appropriately trained on the maintenance and inspection of NVIS installations;
    4. Flightcrews fully understand the importance of reporting NVIS-related problems to maintenance personnel;
    5. Aircraft configuration/conformity is periodically checked to ensure that installed NVIS equipment complies with the Supplemental Type Certificate (STC); and
    6. Current and complete data is available to maintenance personnel to support the NVIS equipment.
    NOTE: An aircraft that does not comply with the STC and/or ICA requirements, or that has inoperative or improperly maintained equipment, should not be operated until corrective action has been taken. Operators may use or apply for Minimum Equipment List (MEL) relief as applicable. MEL information is contained in FAA Order 8900.1, Flight Standards Information Management System (FSIMS), Volume 4, Chapter 4, Minimum Equipment Lists (MEL) and Configuration Deviation Lists (CDL), as well as MMEL Policy Letter 127.

    FAA Raises Safety Rating for Mexico

    WASHINGTON, D.C. – The U.S. Department of Transportation’s Federal Aviation Administration (FAA) today announced that Mexico complies with international safety standards set by the International Civil Aviation Organization (ICAO), based on the results of a November FAA review of Mexico’s civil aviation authority.

    Under the leadership of Secretary Juan Molinar and Director General Hector Gonzalez Weeks, Mexico has made significant progress and is now upgraded from the Category 2 safety rating the country received in July to Category 1. At Mexico’s request, the FAA will continue to provide technical assistance to support and maintain the changes the civil aviation authority has made.

    A Category 1 rating means the country’s civil aviation authority complies with ICAO standards. A Category 2 rating means a country either lacks laws or regulations necessary to oversee air carriers in accordance with minimum international standards, or that its civil aviation authority – equivalent to the FAA for aviation safety matters – is deficient in one or more areas, such as technical expertise, trained personnel, recordkeeping or inspection procedures.

    With the International Aviation Safety Assessment (IASA) Category 2 rating, Mexican air carriers could not establish new service to the United States, but were allowed to maintain existing service. Now with the Category 1 rating, Mexican air carriers can again add flights and service to the United States.

    As part of the FAA’s IASA program, the agency assesses the civil aviation authorities of all countries with air carriers that operate or have applied to fly to the United States and makes that information available to the public. The assessments determine whether or not foreign civil aviation authorities are meeting ICAO safety standards, not FAA regulations.

    Countries with air carriers that fly to the United States must adhere to the safety standards of ICAO, the United Nations’ technical agency for aviation that establishes international standards and recommended practices for aircraft operations and maintenance.     Driving Toward NextGen

    Williams Trophy Luncheon

    Thank you, David [Whitestone], and thank you to the Washington Airports Task Force for giving me the opportunity to participate in this celebration.

    Make no mistake about this: Gary Kelly and Southwest Airlines are serious. Over the last year and a half, I’ve been making a steady drumbeat for NextGen. Southwest Airlines was in gear for NextGen long before I got here. I can say without hesitation that Southwest Airlines is a leader when it comes to NextGen.

    You can see it in their business operation. They aren’t content with the status quo. They recognize that NextGen is the front door to opportunity; that it’s the key to operating successfully and profitably in a system that doesn’t look like the one from 10 or 20 years ago.

    Gary Kelly and Southwest Airlines and several airlines are saying, “This is not your father’s NAS,” and they’re 100 percent right. NextGen transitions us from an air traffic control focus to a more holistic approach – a system focus that makes full use of all of the technology that’s out there today and will provide benefits from technology that’s yet to come.

    And this didn’t “just happen.” Back in 2008, Southwest committed to NextGen full-bore. This business decision was driven by a difficult economic environment, the high price of gas and competition. When you cut your fuel costs, you boost the bottom line. That’s not high level math, that’s street-smart maneuvering. Southwest committed to upgrade its 737 fleet with required navigational performance capabilities – RNP. They committed to train their aircrews for the performance based navigation operations made possible by NextGen.

    This wasn’t a decision for the faint of heart. They’ve equipped all of their aircraft to be performance based navigation capable. That was $175 million. They’ve trained 6,000 pilots to fly the approaches. In about a month, pilot training should be complete and their pilots will be approved to conduct RNP routes and approaches that require authorization. As part of its internal training plan leading toward operational approval for RNP use, Southwest has a self-imposed requirement to log approximately 3,200 RNAV GPS approaches.

    Southwest Airlines actively supports the FAA in the development and implementation of RNP procedures across the nation, either in the role as lead carrier or as a participant with other operators. Last year, 59 RNP procedures that required special authorization for participating aircrafts and aircrews were published for 15 airports, including 10 served by Southwest. Eventually, these types of procedures will be developed and implemented through a continued collaborative effort, at airports across the country.

    So that’s a mouthful of numbers and acronyms, but what it means is that Southwest Airlines and Gary Kelly understands that the system of tomorrow is hinged on the equipment, and they have no intention of waiting until tomorrow comes to get the new stuff into their cockpits. When they hear “best equipped, best served,” they don’t want to be in that line, they want to be at the front of it.

    None of this is free, and I’ll be the first to admit that if you look back, the FAA has been slow on our promise to deliver the goods. But with NextGen, we are, and let me say without equivocation that Southwest and Gary Kelly are putting their airline in the optimum position to cash in on it and providing incentive for others to match them.

    With both leadership and vision, not only did Southwest commit to this effort financially, but they also did so from a company culture standpoint. From the start, Gary Kelly and Southwest took great pains to educate and motivate their entire work force on the wide-ranging benefits to be gained from becoming a performance-based navigation airline; benefits not only to the company, but to the country as a whole. I’m talking about reduced airspace congestion, more efficient air travel, reduced emissions and a reduced dependency on oil.

    The savings adds up to real money. Performance based navigation means shorter, more direct routes. Southwest figures that for a single minute of time saved on each flight, the annual savings quickly add up to 156,000 metric tons in emissions per year. And $25 million in fuel savings per year. Seconds count.

    At the end of all this, Southwest Airlines will have transformed itself from an airline navigating solely by fixed ground-based navigation aids to one flying satellite-based precise, optimally designed routes that will allow for reduced flight times and contribute to a more efficient national airspace system benefiting the entire U.S. population.

    I’ve been flying in this system for going on five decades now, and I appreciate what Southwest has done. They, and several of their competitors, have shown real leadership in pushing for new technology and the efficiencies that it brings. That’s forward thinking.

    And this kind of approach doesn’t happen in a vacuum. It only happens when an airline like Southwest says, “This is where we need to go, and this is how we’re going to get there.” And then they do it. Congratulations.

    Fact Sheet – Regulating and Licensing Commercial Space Transportation Activities

    Background

    The FAA is responsible for regulating and licensing U.S. private companies and individuals involved in commercial space transportation. To date, the FAA Office of Commercial Space Transportation has licensed over 200 successful launches.

    Licensing Requirements

    • An FAA license is required for any launch or reentry, or the operation of any launch or reentry site, as carried out by U.S. citizens anywhere in the world, or by any individual or entity within the United States.
    • An FAA license is not required for space activities the government carries out for the government, such as most NASA or Department of Defense launches.
    • Once the FAA determines a license application package is complete, the FAA has 180 days to complete an evaluation and issue or deny a license.
    • The FAA evaluation includes a review of: public safety issues; the activity’s environmental impact; any payload to be flown; any national security or foreign policy concerns, and whether or not the commercial space operator is appropriately insured.

    Experimental Permits

    • To help facilitate in the eventual licensing process, the FAA can issue experimental permits, rather than licenses, for the launch or reentry of reusable suborbital rockets.
    • Experimental permits are issued for research and development; demonstrating compliance with requirements leading to licensing; or crew training prior to obtaining a license.
    • No person may operate a reusable suborbital rocket under a permit for carrying any property or human being for compensation or hire.

    Oversight

    • When an FAA licensed space activity is scheduled, FAA safety inspectors will attend even if it takes place outside the United States.
    • The FAA has the authority to suspend or revoke any license or issue fines when a commercial space operator is not in compliance with statutory or regulatory requirements.

    Press Release – FAA Proposes $221,650 Civil Penality Against Flying Vikings

    LOS ANGELES – The Federal Aviation Administration (FAA) proposes to assess a $221,650 civil penalty against Flying Vikings, Inc. a flight school in Hayward, Calif., for allegedly failing to complete the required training for its staff and failing to maintain training records, as required by Federal Aviation Regulations.

    The FAA alleges that from Feb. 1, 2008 to Oct. 23, 2008, the school did not have a chief instructor, assistant chief instructor or instructor who had completed an approved list of training or refresher courses within the previous 12 calendar months, as required. During that time period, the school provided training to 20 students and graduated 10 of them. The FAA reviewed student records and training during the time the school was not in compliance, and took appropriate action when it found discrepancies, including revocation of one pilot certificate.

    The FAA also alleges that the school failed to properly maintain and certify the training records for 11 students between Feb. 1, 2008 and Sept. 10, 2008.

    “Good solid basic training and accurate pilot records are the foundation for pilots to operate safely throughout their flying careers,” said FAA Administrator Randy Babbitt. “We expect flight schools to help provide that solid safety foundation.”

    Flying Vikings, Inc., has 30 days from receipt of the FAA’s enforcement letter to respond to the agency.

    Press Release – FAA Dedicates Recovery Act Funded Fire Station at LAX

    LOS ANGELES, Calif.–The Federal Aviation Administration (FAA) today dedicated a new, state-of-the-art fire station at Los Angeles International Airport (LAX) funded by nearly $11 million from the American Recovery and Reinvestment Act.

    “This project is an example of how the Recovery Act has not only stimulated the economy but also funded a critical safety improvement at one of the world’s busiest airports,” U.S. Transportation Secretary Ray LaHood said. “The new fire station will help ensure the safety of all passengers at LAX for years to come.”

    At 27,500 square feet, the new station is twice as big as the old facility, which was built in 1985. The new station better accommodates the size, volume and nature of today’s emergency response equipment. It has seven bays to house and maintain fire rescue vehicles and also provides living, training and administration areas for 14 firefighters.

    “As a former airline pilot, I know very well how important it is for airports to have the best possible emergency response,” FAA Administrator Randy Babbitt said. “That’s exactly what this new station provides for LAX.”

    The new station is located on the airfield midway between the north and south runway complexes. Construction on the station began in the summer of 2009 and was completed in October 2010. Firefighters moved into the station this month.

    Nationwide, $1.3 billion in Recovery Act money has been made available for both airport improvement projects and air traffic control facility and system upgrades. These Recovery Act grants have been distributed to airports that serve commercial passengers, cargo and general aviation.

    Press Release – FAA Proposes $140,000 Civil Penalty Against K-Mart, Inc.

    WASHINGTON – The Federal Aviation Administration is proposing a $140,000 civil penalty against K-Mart, Inc., of Royal Oak, Mich., for allegedly violating Department of Transportation hazardous materials regulations.

    The FAA alleges K-Mart offered two packages to UPS for transportation by air from Caguas, Puerto Rico to its returned goods center in McDonough, Ga. The first shipment, Sept. 21, 2009, contained 15 three-ounce containers of nail color, which is classified as paint, a flammable liquid. The second shipment, Oct. 26, 2009, contained 18 five-ounce containers of aerosol sun block, a flammable gas. Neither shipment was declared to contain hazardous materials.

    K-Mart allegedly offered the shipments for transportation by air when they were not packaged, marked, classed, described, labeled or in condition for shipment as required by regulations. UPS employees at the Louisville sort center discovered both packages leaking.

    K-Mart, Inc., has 30 days from receipt of the FAA’s civil penalty letter to respond to the agency.

    Press Release – FAA Proposes $168,000 Civil Penalty Against Radiology Corp.

    WASHINGTON – The Federal Aviation Administration is proposing a $168,000 civil penalty against Radiology Corporation of America, Inc., of Delray Beach, Fla., for allegedly violating Department of Transportation hazardous materials regulations.

    The FAA alleges Radiology Corp. offered a fiberboard box to Delta Airlines in Atlanta as checked baggage, Feb. 6, 2010. The box housed a soldering iron containing liquid butane fuel, a flammable gas, which is a hazardous material. The shipment was not declared to contain hazardous materials.

    Radiology Corp. allegedly offered the checked baggage for transportation by air when it was not packaged, marked, classed, described, labeled or in condition for shipment as required by regulations. Delta employees at the Atlanta airport discovered the shipment before it was loaded on an aircraft.

    Radiology Corporation of America Inc., has 30 days from receipt of the FAA’s civil penalty letter to respond to the agency.

    Press Release – FAA Proposes $530,250 Civil Penalty For Aviation Technical Services

    SEATTLE – The Federal Aviation Administration (FAA) is proposing a $530,250 civil penalty against Aviation Technical Services, Inc. (ATS), an aviation repair station in Everett, Wash., for allegedly failing to follow approved procedures while maintaining 14 Southwest Airlines Boeing 737s.

    Specifically, the FAA alleges ATS failed to follow Southwest’s Continuous Airworthiness Maintenance Program (CAMP) during work to accomplish five Airworthiness Directives to detect fuselage skin cracks. ATS used shortened “cradles” to support the aircraft at two of three specified points while they were off their wheels, a deviation from the Southwest CAMP.

    ATS alsoallegedly failed to install and monitor load-measuring cells to ensure the maximum loads did not exceed limits for the engines, wings and horizontal stabilizer locations while the aircraft were suspended in the cradle. The alleged violations occurred between January 2007 and March 2008.

    “We have the highest standards in place to ensure safety,” said FAA Administrator Randy Babbitt, “Maintenance work has to meet those standards wherever it is performed.”

    Aviation Technical Services has 30 days from receipt of the FAA’s enforcement letter to respond to the agency.

More than 120 guests will witness the inaugural departure of an AirTran Airways Boeing 737 jet after a brief ribbon-cutting ceremony on the runway.

    “This is a very special day at the Akron-Canton Airport,” said Rick McQueen, president and CEO. “This runway signifies more than just new pavement, it provides a path forward; to new destinations and new opportunities for decades to come. The improved 5/23 truly is our crown jewel and a vital piece of aviation infrastructure for the region.”

    The improvements to Runway 5/23 include an additional 800 feet of runway length and a vital safety upgrade on the end of Runway 5. The project was born in 2000 as part of a nationwide Runway Safety Area improvement mandate. After careful consideration and a needs justification, the airport and the Federal Aviation Administration (FAA) decided to include the extension; adding to the project’s impact and regional significance. After various federal approvals, construction began in late 2005. The total runway project cost $60 million. Most of the funding to support the Runway 5/23 project came from the FAA’s Airport Improvement Program funds. The airport contributed five percent of the total project cost out of operating revenue. No bonds or other financing tools were used to finance the project.

    Press Release – FAA Proposes Requiring Pilot Certificates to Include Photos

    WASHINGTON – The Federal Aviation Administration (FAA) announced today it is proposing that all pilot certificates include photos of the certificate holder.

    This action follows a requirement that all pilot certificates be made of plastic and contain security features, such as a hologram and an ultraviolet-sensitive layer, to prevent tampering, altering and counterfeiting.

    “The Department of Transportation is committed to keeping the traveling public safe,” said Transportation Secretary Ray LaHood. “This is an important safeguard to help make sure individuals can’t pose as pilots, whatever their intentions.”

    Under the new FAA proposal, pilots would obtain new certificates on which their photograph would appear with a proposed expiration date of eight years. At the end of that time period, pilots would need to update their photo and obtain a new certificate.
    “Our current certificates are plastic and tamper-resistant, but this proposal will make them even more secure,” said FAA Administrator Randy Babbitt.

    If the proposal is finalized as proposed, all new airman certificates would have to include a photograph. Existing pilots with a current commercial pilot certificate would have four years to comply, while a pilot with an airline transport pilot rating would have three years to obtain a new certificate with a photo. Existing private, recreational or sport pilot certificate holders would have five years to comply with the new requirement.

    If finalized, the resulting final regulation will fulfill a provision of the Intelligence Reform and Terrorism Prevention Act, which requires the FAA to issue plastic, tamper-resistant pilot certificates with photos.

    Under the proposal, the cost of the new pilot certificate would be $22. That amount is comparable to drivers’ license fees in many states and would have to be renewed every eight years.

    Press Release – FAA Works to Ease Delays for Thanksgiving Holiday Travel

    WASHINGTON – The Federal Aviation Administration is preparing for a busy Thanksgiving holiday travel week by working with the Department of Defense to clear the way for commercial aircraft to fly in airspace normally reserved for the military.

    “We want to do everything we can to make it easier for people to travel so they can spend Thanksgiving with their loved ones,” said U.S. Transportation Secretary Ray LaHood. “We appreciate the military’s help in making this happen.”

    Air traffic controllers may begin routing commercial aircraft through the restricted airspace at 6 a.m. EST on Tuesday, Nov. 23, a day earlier than in previous years. The use of restricted airspace will end at 6 a.m. EST on Monday, Nov. 29. The busiest travel days are expected to be Tuesday, Wednesday and Sunday.

    Under the agreement, DOD will release airspace off the east coast above 24,000 feet. The added capacity is expected to ease delays during one of the busiest travel periods of the year, saving time and money for passengers and airlines while reducing fuel burn.
    The FAA has developed dedicated routes off the east coast to allow airlines to plan their flights through the normally restricted airspace. Normal inland routes will still be available. Weather permitting, the combination of both sets of routes is expected to ease congestion.

    “The FAA is using all the tools available to try and give airlines the most efficient routes so air travelers can reach their destinations safely and on time,” said FAA Administrator Randy Babbitt.

    “The nation’s air traffic controllers are committed to upholding the safety of the system while working the most efficient airspace system in the world,” said NATCA President Paul Rinaldi. “Over the past year we’ve experienced a movement toward collaboration at all levels of the agency and we look forward to continuing to work together to improve air travel for the flying public.”

    The DOD is also allowing commercial flights to use restricted airspace in other parts of the country. These include:
    Airspace over the Gulf of Mexico to ease congestion for commercial aircraft flying between Florida and the Louisiana and Texas areas, as well as points beyond.

    Airspace over Twentynine Palms in California to ease congestion for commercial aircraft flying to and from markets in Southern California.

    Airspace over the White Sands Missile Range in New Mexico to allow for more direct routings for aircraft flying over the Southwest.

    FAA Finalized Fatigue Damage Rule

The rule specifically addresses widespread fatigue damage (WFD) with the intent of “providing for the establishment of safe operational limits and the maintenance actions necessary to preclude WFD prior to reaching those limits.

Manufacturers have between 18 and 60 months to comply depending on the particular aircraft type.

    Once manufacturers establish these limits, operators of affected aircraft must incorporate them into their maintenance programs within 30 to 72 months, depending on the model of aircraft. After the limit is in the maintenance program, operators cannot fly the aircraft beyond that point unless the FAA approves an extension of the limit.

    “Safety is our highest priority. This rule provides a comprehensive approach to the problem of widespread fatigue in aging aircraft,” said U.S. Transportation Secretary Ray LaHood. “Requiring carriers to regularly inspect their aircraft for possible fatigue is essential to ensuring the highest levels of safety.”

    “We’ve addressed the problem of aging aircraft with numerous targeted regulations and 100 airworthiness directives over the years,” said FAA Administrator Randy Babbitt. “This rule is a comprehensive solution to ensure the structural safety of today’s airliners and the airplanes of tomorrow.”

    An airplane’s metallic structures are stressed and can develop cracks when they experience repeated loads such as the pressurization and depressurization that happens on every flight. While airlines regularly inspect aircraft for cracks exceeding a certain size, WFD involves aircraft developing numerous tiny cracks, none of which would have raised concerns individually but which together run the risk of joining up and impairing the structural integrity of the plane.

    The new regulation applies to airliners with a takeoff weight of 75,000 lbs. and heavier. It also applies to all transport designs certificated in the future.

    The affected models, totaling 4,198 U.S.-registered airplanes, are listed in the rule.
    The FAA is working closely with the European Aviation Safety Agency (EASA) and other national authorities to harmonize this rule with their regulations as much as possible. EASA is now developing rulemaking to address WFD, and the FAA participates in that process.

    Press Release – FAA Accepts Final FTI Outage Review Panel Report

    The Federal Aviation Administration (FAA) today accepted the second and final report on the November 2009 telecommunications outage prepared by an independent review panel assigned to investigate the incident.

    FAA Administrator Randy Babbitt had asked the panel to examine the cause of the FAA Telecommunications Infrastructure (FTI) outage and to recommend strategies to reduce the potential for similar future outages. He also asked the panel to examine the FTI’s present and future architecture as it relates to emerging technology and future FAA systems.

    The FTI system operates 24 hours a day seven days a week and provides communication support for the National Airspace System. Harris Corporation operates and maintains the FTI for the FAA.

    Last April the FAA began carrying out the panel’s initial recommendations which included:

    • Developing new automated tools for making configuration changes to network devices
    • Increasing FTI workforce staffing during network maintenance
    • Developing an alternate means for the entry of flight plan information to limit the impact of telecommunications network failures on the flight plan entry system.
    • Creating two network enterprise management centers which give the FAA greater situational awareness of network activity and maintenance
    • Installing additional cybersecurity measures throughout the National Airspace System

    The final report on the FTI outage lays out 14 long-term strategic recommendations the FAA should pursue as it transitions to future network systems. The FAA has already begun evaluating and working through the recommendations which revolve around five areas:

    • Governance: the decision making process for FAA systems
    • Situational Awareness: FAA network monitoring and information sharing
    • Interoperability: data sharing between systems and stakeholders
    • Resilience: ability of a network to continue operating under a variety of conditions
    • Cyber Security: the ability to thwart, detect, and respond to any attempts to compromise the system.

    On the morning of Nov. 19, 2009 the FTI experienced an outage that resulted in system-wide delays. During the four-hour event, air traffic controllers managed flight plan data manually and safely according to FAA contingency plans. Air traffic control radar and communication were not affected during that time and critical safety systems remained up and running.

    The panel confirmed the FAA’s preliminary assessment that the November outage was caused by a series of errors in network maintenance and monitoring during a telecommunications upgrade.

    The panel is made up of the following participants: FAA Chief Information Officer David Bowen; Assistant to the President and U.S. Chief Technology Officer Aneesh Chopra; Department of Transportation Chief Information Officer Nitin Pradhan; Noblis CEO Amr Elsawy; former Director of Command, Control, Communications, and Computer Systems Vice Admiral (Ret) Nancy Brown; FAA Air Traffic Organization (ATO) CIO Steve Cooper; and FAA Assistant Chief Counsel for Acquisition and Commercial Law Patricia McNall.

    FAA Sets Crew’s Alert Parameters

    Alerts should be designed so that the pilot can acknowledge the problem and suppress the alarm. According to the FAA, the system should automatically remove the alert when the conditions no longer exist, preventing a “nuisance.”

    The FAA recommends manufactures use six or fewer colors.

    Alert colours on the flight deck for future aircraft will have red warnings, amber or yellow cautions and any colour but red, amber, yellow or green for advisory alerts. Attention cues can not rely solely on color but must alert two senses.

    Weather, terrain or traffic displays may still use the four colours, but “must not adversely affect flightcrew alerting.”

    FAA Proposes Safety Management Systems for Airlines

    WASHINGTON – In a continuing effort to take the U.S. aviation system to the next level of safety, the Federal Aviation Administration (FAA) has proposed to require Safety Management Systems (SMS) for most commercial airlines.
    Safety management systems give operators a set of business processes and management tools to examine data from everyday operations, isolate trends that may be precursors to incidents or accidents, and develop and carry out appropriate risk mitigation strategies. They are a formal approach to managing an organization’s safety through four key components – safety policy, safety risk management, safety assurance, and safety promotion.

    “Safety is our top priority,” said U.S. Transportation Secretary Ray LaHood. “This program can help airlines identify possible safety problems and correct them before they lead to accidents.”

    “We need a holistic approach to safety that allows us to spot trends in aviation and make necessary changes to help avoid incidents and accidents,” said FAA Administrator Randy Babbitt. “Safety Management Systems are a critical piece of a successful safety culture.”

    The requirements of the SMS proposal would define “what” is expected rather than “how” the requirement is to be met. This allows for development and implementation of an SMS that matches the size, complexity and business models of diverse organizations in ways appropriate to their unique systems and operating environments.

    Under the proposed rule, scheduled air carriers and a few others operating under Part 121 of federal aviation regulations would be required to implement an SMS within three years. The carriers would have to submit their SMS implementation plans to the FAA within six months of the final rule’s effective date. The plan would be required to show how the airline intends to comply with the rule within the three-year implementation period. An SMS would not take the place of regular FAA oversight, inspection and audits to ensure compliance with existing regulations

    The FAA began exploring system safety-based oversight concepts in the mid- to late- 1990s. During that time, the agency concluded system safety has to be practiced by operators, repair stations, flight schools, other aviation service providers and the agency itself. In 2006, the International Civil Aviation Organization (ICAO) required that all member countries implement SMS standards for operators and approved maintenance organizations.

    The FAA’s own Air Traffic Organization has already begun implementing an SMS, and the agency recently issued a notice of proposed rulemaking that would require FAA-certified airports to establish SMS for all airfield and ramp areas.

    The estimated cost of this proposed rule for U.S. air carriers is $390 million, with estimated benefits of $470 million. The proposal conforms to ICAO SMS provisions.

    Press Release – FAA Awards $18 Million Environmental Grant to Seattle-Tacoma International Airport

    WASHINGTON – The Federal Aviation Administration (FAA) announced the award of its largest Voluntary Airport Low Emission (VALE) grant for an $18.3 million project at Seattle-Tacoma International Airport (Sea-Tac) to improve air quality and to reduce the use of conventional fuels at the airport.

    With the VALE grant, Sea-Tac will be able to install a centralized preconditioned air plant that will allow aircraft arriving at the gates to shut off their auxiliary power units and connect to a cleaner central heating and cooling system. This project will greatly reduce aircraft emissions on the ground.

    “This program is helping airports around the country make needed technological investments so they can be more environmentally friendly,” said U.S. Transportation Secretary Ray LaHood.

    Since the first VALE grant award in 2005, the FAA has funded 40 projects totaling $83 million dollars.

    FAA Administrator Randy Babbitt announced the grant during a press conference in Seattle where he highlighted environmental efforts under way at Sea-Tac and by the Alaska Air Group (AAG) as examples of the kind of innovative work being done in the aviation community.

    “The FAA is encouraging airlines and airports to find creative ways to reduce aviation’s impact on the environment,” said Administrator Babbitt. “NextGen technology will also help aviation go even greener by significantly reducing the amount of fuel burned during air travel.”

    Administrator Babbitt discussed an innovative program under way in the Sea-Tac area known as the Greener Skies over Seattle project. The project began in early 2009 with the Alaska Air Group (AAG), which includes Alaska Airlines and Horizon Airlines, the Port of Seattle and the Boeing Co. The AAG is seeking to improve efficiency at Sea-Tac through expanded use of NextGen satellite-based technologies to provide more direct and optimized descent paths to landing.

    The program has the potential to provide environmental benefits to the region through reducing fuel burn, emissions, and the number of people impacted by aircraft noise. In addition, lessons and benefits gained from this effort may be transferred to other airports around the nation. In mid-2010 Greener Skies over Seattle became a FAA project and the first phase of Performance Based Navigation instrument flight procedure development is now under way.

    Press Release – FAA Dedicates New Reno Air Traffic Control

    RENO, Nev. – The Federal Aviation Administration (FAA) today dedicated a new, modernized 195 foot-tall air traffic control tower at Reno-Tahoe International Airport.

    “Upgrading our aviation infrastructure is one of our highest priorities, and this new tower will provide Reno-Tahoe International Airport with one of the nation’s most modern air traffic control facilities,” U.S. Transportation Secretary Ray LaHood said.

    “This is a great day for aviation in Nevada,” said FAA Administrator Randy Babbitt. “The new tower will improve safety and efficiency by providing controllers with better airfield views and more modern equipment.”

    The new tower was built with FAA facilities and equipment dollars, which are used to modernize the air traffic control system.

    Reno’s new control tower is almost three times the height of the old tower, which was built in 1957. The airport’s runways are considerably longer than they were when the old tower was built, which made it challenging for controllers to see aircraft on certain taxiways and runways. The old tower also experienced glare from lights on the cargo areas.

    Renocontrollers also now will have state-of-the-art equipment that includes multicolor radar displays, touch-screen voice communications, and touch-screen work stations that provide instant information on everything from weather conditions to air traffic manuals. Double-thick sun shades will help prevent glare inside the 610-square-foot controller work area. Additionally, the new tower will have two backup power systems to help ensure uninterrupted operations.

    Tower controllers direct aircraft within about five miles of the airport up to an altitude of 3,000 feet. The new tower and a 10,000 square-foot base building cost $29.4 million to build and equip. Construction began in January 2008. Reno-Tahoe International Airport served about 100,000 flights in 2009.
