										<content:encoded><![CDATA[<p>There&#8217;s a general consensus among the people who deal with terrorists that terrorists like to take credit for disasters,  even when they&#8217;re not responsible for them. Ownership of violence is part of the whole extremist <em>&#8220;psych-you-out &#8220;</em> ideology.  To claim responsibility for an act one did not do to is to &#8220;claim&#8221; one for the malevolent<em> gipper</em>, to make one appear more powerful, especially when actually  helpless, and/or to appease whomever one is confessing to with false collateral by churning out false confessions.</p>
<p>But consider this: if I say I am Santa Claus or the Easter Bunny, it does not mean I <em>am</em> Santa Claus or the Easter Bunny.    Legally, it&#8217;s going to take more than tall talking and word of mouth to establish that claim in court. It will take heavy duty concrete proof to make that claim stand up in a court of law. The head of the Engineering Department at the BEA (France&#8217;s version of the NTSB, the Investigation and Analysis Bureau) Christophe Ménez said in an interview &#8230; that evidence shows that last month’s Ethiopian plane crash was not a result of an explosion. &#8220;The fuselage and other heavy parts, such as the engine, all sank together, and the plane’s wreckage was in close proximity, which indicates that the airliner did not explode. &#8221;</p>
<p>The investigation of Ethiopia Airlines Flight 409 so far does not develop a case for terrorism having anything to do with causing the crash. But even if it were true (and we don&#8217;t think it is), <strong>the primary liability rests with the operator, Ethiopia Airlines.</strong>  This is not a legal opinion, just my own opinion. </p>
<p>Now let&#8217;s speculate. If it <em>were</em> a terrorist act,  it might derail a law suit against component manufacturers in the United States, but an experienced lawyer would tell us that if an act of terror downed the plane, it would not budge legal claims against  Ethiopia Airlines.<strong>  Under the various treaties that govern air travel, the operator has the primary responsibility for that innocent passenger who paid good money to get on that plane.</strong></p>
<p>The big news services are not the source of this claim; it looks like it is coming from a blog network, so it appears to be a rumor rather than fact, or a rehash or repost of an earlier theory. There is no plausible evidence of sabotage.   </p>
<p>But we are still hoping for more evidence, and for the families, more remains, to be discovered by the <a href="http://www.marinetraffic.com/ais/shipdetails.aspx?MMSI=309814000" title="Odyssey Explorer is a 251-foot state-of-the-art dynamically positioned ship owned and operated by Odyssey Marine Explorations" target="_blank" data-wpel-link="external">Odyssey Explorer</a> in the ongoing marine search for definitive evidence. </p>
<p>The terrorism theory has already been postulated and discarded once so I don&#8217;t give much credence to it.  But more than anything, I regret seeing these things crop up to stress the victims families even more. They&#8217;ve already been through too much; and the investigation is going to take a long time. However as we can not confirm that number anywhere, we believe the confirmed dna-identified deaths are of a much smaller number. </p>

<strong>ET Flight 409 Accident Update 9 &#8211; 10 February, 2010</strong></p>
<p>Ethiopian Airlines would like to express its position on the latest speculative reports released on the cause of the accident on ET-409, 25 January.</p>
<p>As a member of the investigation team, Ethiopian Airlines strictly adheres to the ICAO annex 13 regulation, in which it is mandated to refrain from any inconclusive comments on the process of investigation.</p>
<p>The investigation is still in its early stage and the CVR (Cockpit Voice Recorder) and the aircraft wreckage are not yet retrieved for analysis, it is therefore, too early to conclude the cause of the accident. Ethiopian Airlines does not rule out all possible causes including the possibility of sabotage until the final outcome of the investigation is known.</p>
<p><a href="http://www.ethiopianairlines.com/en/news/default.aspx" data-wpel-link="external" target="_blank">Ethiopian Airlines</a> would continue to cooperate with the investigation team to complete the process in accordance with the ICAO regulation and reveal the truth.</p>
<p>We share the pain and sorrow of the families of our crew and dear passengers who have lost their lives in the accident.</p>

<p>Other than one British citizen and one Syrian, families of all of the victims have submitted DNA to help identify relatives remains although only a portion of the 90 aboard have been found since the crash on January 25 into the Mediterranean sea minutes after takeoff. The plane&#8217;s black box and main sections of the plane have not yet been located but a U.S. Navy ship, the USS Ramage, detected signals from the black box flight recorders at a depth of 4,265 feet </p>

<p>Investigative crews sort through baby sandals, and airplane parts drifting ashore. People are questioning why the flight was not delayed due to the storm raging at the time of takeoff.</p>
<p>The USS-Ramage, and   US P-3 surveillance aircraft are helping with search and rescue efforts.</p>
<p>The plane was last serviced on Dec. 25.</p>
<p> Reports abound that the plane was seen to be on fire on its way down.  If reports of an engine fire proved to be correct, it would have been difficult to handle at such a low altitude; but reports of a lighting strike, compounded by poor visibility and high winds compounded by a bird strike are equally as possible.</p>
